You were then asked if a man would be justified in the same scenario.......you won't answer. The answer is........ of course not. It's not really a double standard, it's just societal norms. I teach my daughters to go ahead and clock (punch, wallop, kick in the balls, etc) any man who touches them uninvited. I teach my son to never strike a woman under any circumstance except a fight for his life. You can agree or disagree, but I'm around alot of men.....we pretty much teach our kids some form of that lesson.....as we were taught. For me, it's why these types of (harmless) incidents are always funny.......I'd rather someone just got their clock cleaned and we move on.....because all the rest of this is just a waste of time. I rarely think of clocked as punched I think of it as struck in some manner in this case as backhanded across the face. I have answered your question repeatedly I have simply refused to be baited into a reducto ad absurdum argument.

I've prosecuted it. Thanks for chiming in. I hoped you would a few pages back. Here's my question: Let's say you know that Person X pinched Person Y on the rear. What other questions would you need answers to before deciding it is criminal? Or are those facts sufficient? Certainly, if Person Y consented it's not criminal, but what else would you need to know.

If he hadn't pinched her for the photo, how many people would have seen her image. Since he did, and it has gone viral(Google "Peter Sagan Pinch" and you get 162,000 results! Here's one http://www.dailymail.co.uk/news/article-2303916/Cyclist-Peter-Sagan-sparks-sexism-row-fans-pinch-idea-new-internet-craze.html?ito=feeds-newsxml) and she will likely make millions of impressions which, in the modeling world, can only lead to more bookings. So a childish prank for a photo may actually work out to her benefit, his detriment (or not), and an increased awareness of something (which is currently under hot debate in this thread). |

But in the case at hand here.........no. I think this the point that everyone gets hung up on. "Those who would be offended" see this as a clear crossing of the line.....those who worry more about SERIOUS and REAL assaults see this as stupid, and nothing more. Stupid gets you into trouble, but let's not confuse the two, or the amount of trouble each can garner you. Trinna.......I'm pretty sure I understand fighting for my life as well as anyone on this board. |

Every case is fact dependent, but the facts here would be sufficient. A second degree assault is an unlawful/ offensive touching (or an intent to frighten, depends on the theory you're going on). A fourth degree sexual offense is unlawful/ offensive touching on sexual body parts (ie breasts, buttocks) Edited by trishie 2013-04-04 1:58 PM |
