Pretty unbelievable...if I understood correctly, the language could have difficulty under a court challenge.  Too bad they had to go there in the first place though!

Hope the court challenge happens fast.  I've been wanting to ride up the new(ish) Central City road and out to Peak to Peak Hwy.  Guess I better take my license in case I get pulled over.

Thanks for posting this.  I sent the e-mail as recommended in the link.

If this is how Black Hawk wants to manage their town, I'm taking my tourist dollars elsewhere.

1. Email or Call the Black Hawk City Council
[email protected]   Council phone: 303-582-2212

To: Mayor David D. Spellman and Aldermen Linda Armbright, Paul G. Bennett, Diane Cales, Kathleen Doles, Tom Kerr, Greg Moates

Please restore bicycle access to Gregory Street and all Black Hawk streets. Your ban is closing a major cross-state route to bicyclists preventing residents and tourists from biking.

2. Donate to the legal efforts
We are in the midst of a legal and legislative campaign to overturn this ban and prevent it from spreading to other cities in Colorado. Your donation is the only way we can afford to do this.

Please join our campaign or make an extra financial gift today!

3. Spread the Word
Get the latest news by subscribing to our eNews and fan our Facebook page.

See a map of banned streets by clicking on "Press Releases" on Black Hawk's website.

While I definitely don't support this ban, I must say that they do have narrow roads and the amount of bus traffic plus the food/liquor trucks that are always delivering to the casinos make it a really dangerous situation for riding. Even walking is sometimes a gamble if you have been there during one of those time where the buses are just coming non-stop.

Again, I am against the ban, but when I heard the city Admins talking about how the buses and trucks coupled with the CO law about 3 feet leeway for cyclists mad it impossible for the large vehicles to comply with that law without swerving into oncoming traffic, I was a bit less angry.

I think this is situation where the town feels like it's in a no win situation and is making a decision that they consider the less of 2 evils.

Having said that, I can see some sort of compromise coming....banning bikes in this state is just not going to fly!

I know that's a little devil's advocate, but I'll play along ;-)

The biggest flaw with that argument is that they have actually stated that we are expected to get off our bikes and walk them.  I'm not familiar with the roads, but that means two things... 1)I'm required to cross the street now and walk against traffic so when I am hit I'm not at fault for not walking against traffic  2) me + my bike next to me is actually going to take up more room on the side of the road.

I wonder if we could work with Bicycle Colorado and organize a mass "walk your bike through town" protest.   A few hundred people walking bikes around that little town should clog up the streets pretty fast

The irony of the ban is its being done for safety reasons, on the assumption that vehicles have to pass bikes if riders don't dismount, becuase the bikes are soooo slow.  Assuming:
 1. the speed limit on these narrow roads is 25mph
 2. The practical ban applies to the roughly 3 blocks that comprise downtown blackhawk

Why wouldn't the internal combustion vehicles just follow behind the cyclists, given the short length of town?  Are they also planning to ticket the delivery vehicles that move through town at 12-15 mph?
It also implies, indirectly, that motor vehicle drivers lack the skill or self restraint (or both) to slow down and follow a bike until there's a reasonable location to pass. Hmm, maybe there's a diferrent ordinance needed up there...

I agree, Steve -- traffic moves so slowly thru the narrow parts that the bikes and cars can move in a line rather than side by side.

There is a rally to protest this on Tuesday, June 29th at the Capitol. I'll be there! Who else is in?

From Bicycle Colorado:

What: A chance to make your voice heard on the steps of the Colorado State Capitol Bulding. The world is watching and we need to show them that Coloradoans won't stand for bike bans!

Who: Bicyclists, families, advocates, and friends of bicycling. More details on speakers to come.

When:
Tuesday, June 29th from 5:30 - 6:00 p.m. (arrive early to make signs)

Where: The west steps of the Colorado State Capitol

Why: The city of Black Hawk has banned bicycles on nearly every city street.  We believe this ban is wrong and sets a dangerous precedent in Colorado.

I checked with CDOT's liaison for bicycling, and she related that while they have no official position at this time, she did point out the following:

"Under CRS 42-4-111(1)(h), local authorities can regulate/prohibit bicycles on city streets that are not part of the state highway system without any input or approval of CDOT. "

Has anyone been in touch with the state Dept of Local Affairs and/or Denver Regional Council of Govts?  Those are the agencies that come to mind as having the multi-jurisdictional reach this issue merits.
