Regular 115 | Subject: Neighbor Fence Questions My newer neighbors built a privacy fence last year. Its right on the property line. I had set 2 bikes leaning against the fence on my side and today they are moved to lean against my chain link backyard fence. They had to come on to my side and move them. What would yall do. I want to go over an let them know that I do not much care for them moving my bikes. If they would have asked me to move them I would be super cool with it.

What possible reason would your neighbor have for coming onto your property to move your bicycles? I have privacy fences on each neighbor's property line and I wouldn't even know if either had bikes leaning on the fence from their side. |

Did anyone see them move your bikes? If not you're only guessing. May be a really good guess but not 100%. You might try the old, "Hey, did anything in your yard get moved? I had a couple bikes get moved around in my back yard and wondered if anyone else's stuff got moved." |

Its a 6 foot high fence that only runs along one side of their property. I have only spoken to them one time. They are very private people and I asked around to the rest of my neighbors and they did not move the bikes. My wife did not move them. Oh well. I will just let it pass. First world problems.... |

To play devil's advocate, that side is not theirs so they are trespassing and have a misconception that they own both sides of the fence. Maybe property laws are different where you live but at least here in BC Canada when it's on the property line each side is owned by the respective land owner that each side resides on. |

While technically true, I play it as a live and let live thing. My neighbor on the south side is a total weirdo. He's anal retentive about everything. He actually power washes his lawn mower in the middle and at the end of cutting the grass. Totally nuts. I've asked him not do set off fireworks because the debris was landing in our pool. Otherwise, it's his neroses and not mine. No harm was done by moving what, from what I read, are junker parts left over from frankenbike building. You do far worse by starting a war than by realizing and acccepting (for technial right or wrong) it bothers them and getting along. |

I thought fences were supposed to be entirely on that person's property. I would have complained about that from day one, but regardless, I would bring it up with them for going on your property in any case. I would never want anybody to think it's okay to be on my property and touch my stuff, unless they had explicit permission. Honestly? I would put my bikes there again and keep my eyes on them to try to catch the perps. But again, I probably have way too much free time... |

Our city wants to treat it as a purely civil matter. I am super easy going laid back but I am not happy with people on my property moving my sons bike. I also learned that they were supposed to ask permission to build it and if any part of it touches my property that I can ask them to move the entire fence and start over. There shed is clearly on my property as well as some of the fence. I now need to see how big of a D-bag I would like to be. |

Same here. Many people dont understand fences and how it affects their neighbors and the rights that the neighbors have to the use of the fence. (same w/ tree branches that cross over property lines) If the fence is on the line, then that side of the fence (which should also be the nicer side) is theoretically yours. You cant do anything to the fence like take it down or damage it, but you can lean, plant or do what ever you want on your side, since it on your property. If they had built the fence a foot or so off the line, then you'd be SOL. But the fact that they only put up a fence on your side and didnt talk w/ you about it sends up a 'red flag' to me since they wouldve had to cross your property line to build the fence in the first place. So it wouldnt surprise me at all if they went onto your property (again) to move your bikes. There seems to be an underlying issue here as well. |

Extreme Veteran 312 | Subject: RE: Neighbor Fence Questions As mentioned above, at least in Illinois, if you build on a property line you can do what you want with your side of the fence. There are many neighborhoods in Chicago where you have a privacy or chain link fence dividing all house lots. If there is a privacy fence and you want to paint your side go ahead. I would make sure to have the discussion NOW. It is not a big issue and the rules of how you both can handle these times can be discussed easily. You don't want to have some major problem come up and then have the discussion. |
