general question...is an employer allowed "bug" a conference room? Colleague of mine and I were chatting in a room and he said, "be careful, you never know if they're listening"... I'm not naive, I'm sure it's done, but wondering if it's legal.. Can an employer record the company phones? I'm under the impression they cannot, but conversely, they do read/scan our emails, so if that's legal, maybe the other stuff is... I'm like the most open person, and my cousin (an NYPD cop) is always telling me how Big Brother sees/hears "everything"-

Here's my lawyer answer:

"It depends".

I am available for consultation, for a small fee.

j/k.

But really, it depends. And "big brother" is typically the government, not your employer, unless you work for the gov't, then I suppose they could be one and the same.

I work for the State Government so all of our phone calls on our Agency Phones I believe are recorded. Our internet access is monitered and can be pulled up at any time if need be.

Not sure about your situation/state laws though.

Where I work, all phone and computer interaction is recordable and can be used against you. But you'd have to be doing something pretty blatant for it to even come up...

I play it safe and never write or say anything that I would have any anxiety over anyone reading or hearing while at work.  I have seen too many people embarassed chatting at the water cooler not realizing who was standing silently behind them.

It depends on the state laws. If you signed a document allowing that when you were hired or after then it's probably okay. You basically have to be made aware of it like recording a phone conversation. In TN at least one party on the line has to know you are being recorded.

Good rule of thumb is not to say anything at work that can be used against you. Save it for after hours but beware who to tell since not all will maintain your secret.
