so sorry you got ripped off, and shame on BB.

I have written "ASK FOR ID" in the signature panel of my credit card.  Maybe 1 time in 10 does the clerk even look at it.

Sorry to hear about your situation.  Unfortunately, as someone who's had a lot of experience in the retail sector, believe it or not, many people (I would even go so far as to say most people) get extremely indignant and hostile to sales clerks who ask for id for a credit card sale.  So it's not surprising that lots of sales clerks figure it's not worth the hassle of getting b*tched at, and they don't do it.  THe people who stole your cards are the enemy here, not some $8.00 an hour sales clerk who probably got his supervisor called on him the last time he asked for someone's id.

I agree... we have done it to ourselves. I am guilty as well. When they want to see an extra ID, I make a face a dig into my wallet uncooperatively and hand them my license. We can complain all we want that they should be able to take it... but you know what, they're human too... and they don't want to take the BS just as much as we don't want to deal with it. So really, if you are to blame anyone, blame us... the community... cause 1/2 the time we're b*tching to the fact that we have to show an extra ID So who's fault is it really?

I MUST be STRANGE, cuz when I'm asked for and ID while paying with a credit card, I mistakenly say, "THANK YOU FOR ASKING."

well aren't you just SPECIAL!!!!!!!!!!!!!!!! (where's the red font color, so I can highlight this), LOL!!

If you don't sign your card, they are always required to ask for ID. The only reason I sign them is to avoid the hassle when I realized that by signing them they stopped asking. I think I"ll stop signing them.

I agree - I don't shop at best buy...ever. I tried their Geek Squad services and they said it would take 2 days to fix my computer...well 4 months later they finally found my computer and 5 months later it was fixed.

I am sorry your credit card was stollen.  that is awful.

However, by not asking for ID, BB was following the Merchant Agreement (with MC or Visa).   If the card is signed, they are not to ask for ID.   It is against the merchant agreement to do so.    I see all the time that they ask for ID, glance at it, and then never look at the signiture you sign for the purchase.   This is not the SOP perscribed by MC.

https://www.mastercard.com/contactus/contactus_mv.html

There are 4 things where you can register a complaint with MC about a merchant - they require a minimum purchase, they charged you a fee to use it, they asked for ID, and they refused to take your card while having a MC logo displayed.

In fact, it is ILLEGAL in the state of CA (I think a clerk took the address off a woman's driver's license, stalked and then assaulted her).

I think that the reason ID theft is so easy is that everyone requires all of your information.   Our Social Security numbers are now considered "national ID numbers" by most people.    Remember when they said "for employment purposes only"?  That is all they should be.

If you want every clerk to ask for your ID, write "check ID" in the signiture line.

hate to burst everyone's bubble here - but if your card is NOT signed with your signature your card should be declined regardless if you provide picture ID - writting "ask for ID" or "CID" is not a valid. this is a family hobby of my brother and father (not mine - I just grumble and show ID) but they have won many law suits and also force store changes. My understandingis it is in the credit card and store credit card agreement that the store must accept a signed credit card AND may NOT ask for additional identification. Actually in CA, I know for a fact that asking for ID to name check a credit card is against state law - my brother won thousands of dollars in class action suite against foot locker - $ went to boys/girls club he got nothing. I'll hunt down the case law on this.

But basically go to your credit card and file a fraud case and let your credit card take care of this for you. My husband lost his card a few weeks ago and the thief went to a strip club and charged $5500 dollars - guess somenone had lots of lap dances that night. We called the credit card and they took care of everything for us... no charges no hassles.

sorry this happened to you though!

Here is the reply from my brother (like I said this is a hobby of his)

Writing CID or something similar on credit cards is a violation of the card holder's duty, and the merchant is required to make the card holder sign the card before acceptance, and possibly demand additional ID.

MasterCard and VISA do not allow merchants to require additional ID. The other cvards do not take any position - arguably, merchants then should take you card without ID b/c you as a card holder, or auth user have no duty to have/show ID.

See
http://usa.visa.com/download/merchants/rules_for_visa_merchants.pdf, pp. 26-35

and http://www.mastercard.com/us/personal/en/contactus/merchantviolatio... - at this web page, you can report offending merchants to MasterCard. Complaining to store and corp. high also helps.

If a card isn't signed, it's not valid. Even if you wrote CID or whatnot on there. The clerk is supposed to ask everyone for ID every time.

Edit: I was just enlightened by tri-momma's post and the visa pdf. The organic market where  I worked as a cashier had us check IDs. I guess there's nothing wrong with checking IDs, but you can't make it a condition of the sale.

I guess the OP should be pissed that the signature was not assessed, not that the ID wasn't checked.

The problems with credit card fraud lie in multiple places:

-- Retail locations where clerks are either not properly trained, or have no incentive to take the time to compare signatures on cards to the signatures on the charge slips. I have found this to be MUCH more prevalent in stores with the "self serve" credit card machines, even if it says "keep credit card out for clerk" on the screen, I can't honestly remember a single time I was actually asked for it.

-- The advent of "no signature required" for purchases under $25. No signature, nothing to compare.

-- Even if your card says, "Check ID" there is no requirement for the store to do so - as mentioned before, Visa/MC don't require merchants to ask for additional identification.

-- There are still a lot of online stores that don't require the CID (# on the back of the card), so this is a boon for folks selling stolen numbers/exp dates, but not the physical cards. And even if you do have the CID, no signature required online. (Though hopefully the police can get a delivery address for the purchased goods.)

-- Retailers that have no incentive to worry about fraudulent purchases as Visa/MC will pick up the tab on it. However, this is changing, as both have been indicating that they will start pushing the liability back down to the retailers - this also may be why Visa gave an initial pushback to Best Buy - even if it's not official yet, the OP may have gotten a clerk on the phone who figured since the policy will probably be changing (even though from what I've read, Visa/MC will be the one doing the legwork), why not see if the customer will take care of it?

Personally, I like the idea of pushing the liability for fraud back down to the retailers, but it's hard to say if it's going to go through, given that the SBA and other Small Business groups are saying that it would put too much burden on smaller businesses. (It's not just signature checking they're talking about, but making sure all computer systems are properly secured as well.)

Billabong, I'd still yell at Best Buy for management being rude and totally unhelpful about the entire thing - even if they can't actually do anything, the attitude of the manager isn't right. Yell more at the credit union and Visa, too.

Thanks for the info and links.

I don't understand it, though. It's almost as if the Merchants and CC companies (and consumers) prefer to to be ripped off.

First, I am sorry your stuff was stolen.  Having had my wallet stolen a decade ago, that is a royal PITA to get everything replaced and your credit report will have "lost/stolen" cards on it FOREVER.

BUT...don't diss Best Buy.  It isn't their fault.  I have had nothing but good experiences with Best Buy.  This would be a stupid reason to never shop there again.  Like many other posters said, your credit card company should cover the fraudulent charges.  If they don't, get another card. No need to give them your business when there are many other cards who WILL cover fraudulent charges.

Someone mentioned buying electronics off of eBay... I'd be VERY leery about this. eBay electronics sellers are notorious for selling refurbushed electronics without disclosing the information.

After Christmas I was in an Apple vendor store and a girl came in because her brand new ebay-purchased Nano didn't work. The repair guy was telling her that her "BRAND NEW *IN BOX*" Nano was actually a combination of at least 3 different used Nano's put together and was impossible to fix under any kind of manufacturers warrenty because it had at least 3 serial numbered parts in it. It was cheaper to just buy a new one. The seller wasn't responding to her communication at all, and she was obviously taking it up with eBay, but man, what a hassle.

Be leerrrryyy!

Not correct - You have to sign them for them to be valid. They are not supposed to accept your credit card as a form of payment if they are not signed. Check ID or CID is not a valid signature, and they are not supposed to accept your credit card as such.

Asking for ID can violate the contract
that merchants have with the companies that process credit card
information and that authorize transactions. These contracts provide
that the merchant follow certain procedures in accepting credit cards
-- and these procedures either implicitly or explicitly prohibit
asking for additional ID beyond a signature. So if merchants are
asking for ID in addition to a valid signature, they won't get in
trouble with the police or the district attorney, but they can get in
trouble with Visa or MasterCard or one of the card company's
intermediaries.

Among those who say you shouldn't provide additional ID if asked is
the Indiana Department of Financial Institutions, Division of Consumer
Credit. I believe you'll find the department's consumer guide
informative:

Credit-Card Signature: Usually all the ID Needed
"When you pay for merchandise with a Visa card, MasterCard, or
American Express any store that accepts these cards should accept
yours too, no questions asked. It's part of the deal that merchants
agree to when they become participating members. They must check your
signature and the card - electronically or by telephone - to be sure
it's valid. Once the answer comes up yes, they can to ahead and
charge. They can't ask you for any further identification - not a
license plate number, Social Security number, proof of address, phone
number, or picture ID."
