I think an excellant example of what you're refering to is the Intelligent Design ruling out of Ohio (I think). Where a W appointed federal judge ruled that teaching ID as science violates the establishment clause. AN excellant example of judicial independence. A well reasoned and well articulated opinion too. I think too often people make assumptions about the Court based upon their feelings on the specific ruling. That's what I was trying to convey. I was asking questions in general. For the record I share the same view of the Court as you do. Although our specific opinions on specific Justices are probably 180 degrees opposite. |
