Irondequoit NY: " An Irondequoit man was sentenced to one year in the Monroe County jail for hitting and killing a bicyclist in Rochester while driving drunk....Merrill 31, who admitted having five drinks before he hit Lenhart on North Goodman Street near Northland Avenue, faced a maximum penalty of five to fifteen years in prison. Judge Patricia Marks offered the lesser sentence in exchange for the plea, over the objection of prosecutors,..."

So a 2 time drunk driver gets only 1 year for killing a cyclist. I don't care if the cyclist was out riding in the dark, this is offensive. A persons life only worth 1 year!!!

I think DUI/DWI laws are largely inadequate around the country, specifically for repeat offenders. As far as I'm concerned, if you get busted once, then you do it again, you have proven that you are reckless and/or incapable of making responsible decisions.

This sentence is low, but I hope there is more to it. He shouldn't get his license back.

I fully believe that this person is getting off far too lightly.

We have mandatory drug sentences that are longer than one year.  This guy killed someone.

A few states allows someone who has a previous DUI who does kills someone to be charged with 1st degree murder (the reasoning is that they have been adequately warned of the risks of their behavior, and repeating it amounts to premeditation). I woudl like to see that spread.

Agreed, this kind of thing makes me want to puke.  It's like the laws are designed to be lenient on the fat, lazy, alcoholics but do nothing to protect those who are actually ambitious enough to be up at that hour doing something to better themselves (not on their way home from an all night bender).

1 year is beyond insulting, regardless of extenuating circumstances (although there are none that I can think of).

She is an elected judge in my County.

This decision has guaranteed my active involvement on behalf of her opponent in any future electoral campaigns.

Her rationale was based on the circumstances of the accident: "The bicyclist, traveling in a driving lane at night, was wearing dark clothing and lacked proper lights or reflectors on his bike." Also, I can't find anything stating that this was his second offense.

We need 300kg bikes!! Sure that would take forever to get up to speed, but once you do, you could ride straight into the drunk driver and have HIM feel the pain.

Accidents like this terrible and needless. A cyclist in my club was hit by a drunk driver in September and is still recovering. I guess a trial won’t happen until after he recuperates. I don’t know if that is the case though, I am just guessing. It was the driver’s second offence. After the first one he lost his license, so this time he was driving without a license.

Figgers.  This dude's probably been walking the streets for the last year and a half with the family still grieving and when they finally get to trial he probably won't even spend the full year in jail. 

I remember the guy that Jen was talking about.  Glad to here he's walking again (kinda).  Hopefully justice is a bit more brutal with our friends up north.
