You may use or download material displayed on Beginnertriathlete.com for noncommercial, personal use only. If you download material, you must retain all copyright and other proprietary notices displayed on the materials. Beginnertriathlete.com services are made available for your personal, non-commercial use only. Data integrity is insured through three levels of redundancy. Furthermore, daily backups and weekly offsite backups provide an extra level of safety beyond simple data corruption.

BeginnerTriathlete LLC gives no warranty, expressed or implied, for the performance of availability of services provided, including, without limitation, warranty of merchantability and warranty of fitness for a particular purpose.


 


Using two or more user accounts concurrently is prohibited. Operation of duplicate user accounts on the BeginnerTriathlete.com forums may result in the accounts being disabled, and the common identities of all accounts being made public in our forums.


Any messages or information you post to the site becomes the sole property of the site operator and may or may not be displayed, at the sole discretion of the site operator. The posting of copyrighted or illegal material is prohibited-- you must obey all applicable local laws, including those of the server and site owner. You agree that any and all information that you submit to the Beginnertriathlete.com, including any and all site listings, business listings, event listings, numerical votes and written comments, may be used by Beginnertriathlete.com for the purpose of providing information about triathlons and triathlon training. Information created by or shared by the user belongs to the user and may be deleted by the user at any time. Users may easily access all of the information they have posted in the public forums by clicking their profile to view links to their posts.

These pages and links are purely for informational purposes and are not the expressed views of Beginnertriathlete.com. Album/Profile Videos
The personal album videos section has been created to be personal videos taken by or for the user.  These videos are NOT to be used for posting other professional copyrighted video content without permission.  Please limit album content to user-created videos  to avoid copyright infringement.


 


We reserve the right to take down any videos that have legitimate copyright issues or videos with crude or offensive content.  If there is a question in your mind about it, it's best not to post it.

Intended use of Personal Data


In many cases, you may use BeginnerTriathlete to read, learn and communicate with other users without revealing any personal data. In order to use other tools, however, such as the Training Log and the Custom Training Plan Creator, you will need to enter your age and fitness levels, and you will likely be uploading your workout data for viewing and analysis. If you wish to use these tools fully, you will be submitting personal data. If you choose to withhold personal data, you may not be able to fully use these parts of the website.


Legal Basis for Processing Data


Under the GDPR, BeginnerTriathlete states that our legal basis for processing personal user data is that the user has given consent to have the data processed for the purpose of the user (and their online coach, if applicable, or other users if the training log is public) to analyze their training and help them improve. Such processing is necessary for the legitimate interest of helping our users train for and complete triathlons.

Any member using the public forums, chatrooms or training logs that are set to 'public', please be aware that ANY information you post in a forum or your public training log can be accessed by anyone.  Do not post any information that you deem to be personal or confidential in public areas if you do not wish it to be seen.


You have the right to "restrict processing" by withholding data. Here is how to use our website without revealing personal information:


How to remain 'private' on BT and still use all of the features? 
If you are a user that wishes to remain anonymous, please go to your user settings, accessed by clicking the "gear" icon at the top right of the screen, and de-select "Is your e-mail publically viewable?"  You can also delete your 'real name.' This way, users will only identify you in forum posts (should you contribute to them) by your username and the information that you post.


Training log privacy
If you wish that your training logs be inaccessible to other users, please configure your 'Privacy Settings' in your 'training log control panel'.  More details can be found in 'Setting up your training log.'  There are various levels of privacy you can configure. The data you submit about your training belongs to you, and is stored in our database until you delete your account.


Data Portability


You have the right to retain and reuse your data for your own purposes. Your data about your personal profile and your training and workouts are stored here for purposes of sharing and analysis. If you have imported these from a device, such as a fitness watch, the original files are retained by you on your device until you delete them. If you have manually entered the workout data, you may choose to also enter this data in a personal log or spreadsheet. You may also print this data from our site at any time, or export it in a spreadsheet by navigating to your Training Log Settings in your profile and choosing "Export log data." We do not hold or record data in addition to what you can see yourself when you are logged in to your user account.


The Right to Object


Under the GDPR, you have a limited right to object to our use of your data for purposes other than our state purpose. Since we do not use your data for other purposes, this should not be an issue. However, you may contact us at [email protected] if you have concerns or want to object.


Automated Policies or Decisions Based on Data


The only application of this safeguard at BeginnerTriathlete is in our Custom Training Plan Creator, in which our computer program creates a training plan for you based on the personal data you input, such as your relative fitness level and speed in the three sports. We are hereby informing you, the user, that personal data entered in the Custom Training Plan creator is used by an automated computer program to product a training plan for you, based on an algorithm. You may bypass this processing by choosing a different training plan from our Training Programs area of the website.
 
Email policy
Beginnertriathlete.com is firmly committed to respecting the privacy of our viewers (people who visit and/or use the site). The following policy explains how your personal information will be treated.
 
Your name and address will not be sold or otherwise shared with any third party. No spam. You may opt in to our newsletter when you register. To unsubscribe, click "unsubscribe" on any newsletter.
 
The only required field to receive our newsletter is your e-mail address. However, to help us improve our offerings by understanding who is reading beginnertriathlete.com, we would appreciate any additional information you can provide by filling out your profile survey upon sign-up. 
 
IP address
We collect your IP address to help diagnose problems with our server, administer our web site, and improve the information and services offered.


Geographical information provided by you in your profile or via your IP address will be used to serve advertisements to you based on regional relevance. For example, a race director in California may advertise only to users in California and Nevada.

If a user enables Tapiriik or Garmin Connect to sync workout data, personal information may be shared with these sites for the purpose of synchronizing and sharing data with your training log at BeginnerTriathlete.

Beginnertriathlete.com collects personally identifiable data such as names and email addresses when voluntarily submitted by a visitor/member or as part of the discussion forum. The information collected is disclosed and can be submitted to an advertiser that we are holding a raffle for for there marketing efforts.  Other than that, this information will never be sold or given to a third party. Your user data will not be used for any purpose other than our stated purpose of assisting and enhancing the triathlon training and knowledge of our users.

This site contains links to other sites. Beginnertriathlete.com is not responsible for the privacy practices or the content of such Web sites. We do not control their privacy and data collection policies and practices and we cannot be responsible for their policies. Please note that these Web sites' privacy policies may differ from ours. We encourage you to read the privacy statement of any web site you may visit.

User Choice and Your Rights to Your Data


As a user, free or paid, you have the right to be informed about how your data is used. You have a right to know exactly what information we have about you, and how it is stored. For a quick look, click your profile (by clicking on your username and choosing Profile) to see at a glance what user information about you is public.


If this data is incorrect, you have complete access to change it yourself, in your Profile Settings. You have the right to erasure or the right to be forgotten. Once you request an account deletion, all of your data will be removed and there will be no record that you were a member of the website.


This site gives users the option for removing their information from our database to not receive future communications by using the Delete Your Account link.


To remove your email address from our email newsletter database, click the "unsubscribe" link at the top of any email newsletter.


To remove your user-submitted training data and posts from BeginnerTriathlete.com, request to delete your account using the Delete Account link at the bottom of any page.

Data Controller


BeginnerTriathlete and its parent company, Performance Triathlete, processes personal data both as a Processor and Controller, as defined in the Directive and the GDPR.


For purchases of membership and coaching on the site, Authorize.net and PayPal process payment data as the Processor. These transactions occur at Authorize.net and PayPal. Your financial and payment data is not stored at BeginnerTriathlete. You, the user, are the Controller of your payment information. BeginnerTriathlete does not have access to your credit card or payment information, and can see only your name, the amount of the transaction, the type of card used to pay, the service term for which you paid, and when the transaction was successful.


BeginnerTriathlete adheres to the Directive of 1995 and the GDPR from May 25, 2018. Our payment processors, Authorize.net and PayPal, also adhere to these practices and regulations.


All workout and training log data is stored on our secure servers provided by PD9 Hosting in accordance with the highest security regulations.


Limitation of Liability


Beginnertriathlete.com and our affiliates and sponsors, are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to the Beginnertriathlete.com web site, our web site related services and/or content, or information contained within the web site. Your sole remedy for dissatisfaction with the Beginnertriathlete.com web site and/or our web site related services is to stop using the Beginnertriathlete.com web site and/or those services.

Indemnity

You agree to defend, indemnify, and hold Beginnertriathlete.com, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of the terms and conditions of this Member Agreement.

As a commercial user utilizing the free public forums of BeginnerTriathlete.com, please make all efforts to follow these guidelines, in fairness to those who choose to pursue legitimate paid advertising, and who keep this site online with their support.

Definitions:

Commercial User: Any registered BeginnerTriathlete member who:

A) Owns or operates a triathlon or sports-related business.

B) Is employed by a triathlon or sports-related business

C) Produces and sells triathlon or sports related merchandise or sells triathlon or sports related services.

--Commercial users must fully disclose their affiliation in their signature. For example:

Sales information, product advertisements, pricing information, or other 'sales pitch' information is not allowed in signatures.

Forum Participation Guidelines and Restrictions:

--Commercial users must always post in a 'responsive' manner with regards to any product or service they (or any entity with which they have a direct business relationship with) sell or represent. Meaning, discussion contributed must be limited to responses to specific questions or prompts from BeginnerTriathlete members, or corrections of misinformation. In other words, a BeginnerTriathlete member has to bring it up first.
 
--Pricing information and other sales dialogue must be confined to private conversations with BT users (PM or email).
 
--Commercial users may not use the public Classifieds forum to post products or services, unless prior permission is granted from the site administrator.
 
--Please be honest when representing yourself on BeginnerTriathlete.com. Using two or more user accounts concurrently is prohibited. If you operate duplicate user accounts on BeginnerTriathlete and post as a shill, or post in a manner that hides your commercial affiliation, the entire posting history of all your accounts will be wiped from BeginnerTriathlete, and the action will be made public. BeginnerTriathlete.com reserves the right to check/verify all incoming internet IP addresses for verification.

Exceptions

Threads may be started in order to solicit user input and opinions regarding a product/service in development. Any abuse of this exception will not be tolerated. Please contact the administrator/moderators for permission.

A couple examples:

If you are a Commercial user and a user posts a question about your product/service, you may post a reply containing only such information as requested. However, if a user asks a general question such as "how can I increase my running speed" or "what's a good book for...", please do not suggest your product in reply.

Similarly, if you are a retailer and a user asks a question specifically about your retail business, you may reply with such information. But if a user asks "where can I find an xyz bicycle?", please do not advertise your own business in response.
