Subject: Trespassing Rules! PhatnLazy!
Hey buddy,

I go and swim the lakes all the time. Typically I will have a kid with me, so they can watch to see if I get attacked by anything. Gotta have a survivor to tell the stories ya know

Anyhow,
Today we did get attacked, but not by a gator or dog. It was an old man. He came from accrossed the street and screamed and yelled at my kid.

So, I tried to use the training for ironman plea, but he was a VERY angry man, so we just bid him a good day and left.

Question #1 - are these lakes private? I was in the one off Hutchison and Mobley.
Question #2 - how much trouble can I get in for that?
Question #3 - does me being in there give him the right to scream at use the "f" word and all that and make my 11 year old kid cry?

oh-- and the swim was great, waters are cooling a bit.

Question? Was the lake on private property or accessible to all? Was it clearly posted with no trespassing signs? And the fine gentleman you met was utilizing his first amendment rights however I could see a disorderly conduct charge in his future if there was a victim to his outlandish conduct. As far as any trouble, the owner of the property would have to issue you a trespass warning with law enforcement present only if you returned and was caught on the property could one be arrested for a misdeameanor crime.

accessable. Hutchison winds right along the edge of it, all I had to do was walk thru the weeds. My kid was sitting on the grass. No signs.

Most the lakes have no signs. the lil ponds (that I wouldn't swim in anyways) always have those no fishin swimming signs, but I think it is for health reasons.

yeah, can you imagine,, you met TJ, lil dude was sobbing.

anyhow, I don't think I will enter that lake at that point any more.

But, it sounds like if I am ruinning or on my bike and stop and swim I am ok? Say Lake Magdalene, or Lake Carrol, or Pine Lake?

i used to swim in places like this in Florida.  It is probably a private lake but considering how many houses there are I doubt they could tell you were not a home owner there.  Just tell them you live up the street...maybe change your route so you don't go by that dudes house.

 

if that doesn't work switch lakes...you seem to have a bunch there.

I tend to call the nonemergency phone number of police and ask. Then if someone gives my crap I tell them ...blah blah...call the police I can be here.

I was told over and over this one pond you couldn't swim beyond the ropes. No law against it I found out...so I do.

i have outlaws (ex-inlaws) who live on Lake Carrol. Just park at White Sands beach and swim from there. No one ever questioned me.

I say regardless of the fact you may have been trespassing the old guy had no need to speak to your child in such an aggressive way. Probably worth a visit back to see him on your own and ask what he thought he was doing. see if he is so aggressive when he is talking to an adult.

checking with the landowner/local police probably a good idea too. we do similar when we go rough shooting and let them know each time we are going to be there so if anyone challenges us we can give them the number and when they call the person at the other end is ready for it.

Or just chin the guy !!!

The "No swimming beyond ropes" is more of a liability warning than a "law". Just in case some kids swim outside of the ropes and have an accident, and the lifeguards don't see them as they are faraway. 

If you choose to swim outside the ropes and get into an accident, you don't really have a case to sue. 

At least it's what I understand.

We have a private lake in the center of our subdivision which you can't get to without crossing private property. 

Our association rules allow fishing by residents but prohibits swimming.  The resident five foot gator tends to discourage it also (and keeps the duck population under control).

I am not going to go see the dude until afte my 140.6, and then I won't care. Can;t get any bad mojo going rioght now.

does anybody have any tin foil I can borrow to protect my head from all these aliens trying to get me?
