One pet peeve of mine, is the interpretation by individuals, that to invoke the 5th amendment is to concede guilt.

Consider watching this video: http://www.youtube.com/watch?v=GMQYB2Coufg

Without having watched the video, my understanding of the 5th amendment is that you have the right not to get yourself into trouble by speaking, so you have the right to say nothing. How am I doing?

PennState - 2009-10-03 7:17 AM I think in the context used by 'famous' defendents (ie; when there is a fair amount of knowledge of the case in the media) that the 5th can make you seem guilty. But yes it is not an admit of guilt.

I agree with you 100% but expand that and ask, "why?"  IMO, the statement "...the 5th can make you seem guilty." is caused by ignorance of the purpose of this amendment.

In a previous thread MrTony was clearly correct in his position but the majority of the posters in the thread were blasting him on his position not to answer a police officer's questions.  The misguided feeling by many is that "if I cooperate fully, the police will see my innocence."  The proper way to look at this is to understand that you gain nothing but could possibly implicate yourself even if you are innocent.  People truly don't understand the purpose of the Bill of Rights in this country.  There are many who can regurgitate a 50,000 ft view definition or associate a definition to the right amendment number if it's multiple choice but that is not the same as understanding the true meaning.
