LOL I’ve always wondered where people get their value system. Presumably parents and life experiences? I do find it interesting that in general people tend towards more conservative values as they get older....at least according to demographics.

When young, most of us have relatively few resources and relatively little experience.  If you have less than average and are inexperienced, liberal/socialistic "ideals" are quite attractive as you'd have more (they force everything to the average) and don't have to think (or accept consequences for mistakes) in that scheme than not.

I'm now far more "experienced" than I was at 20 and I've accumulated more than average.  Adopting those same "ideals" that were attractive at 20 aren't nearly as valuable and would cost me substantially.

Full disclosure:  I was never particularly liberal/socialistic as a 20 year old.  I have, however, been accused many times of being too conservative, hard-hearted, etc.

Having 'skin' in the game changes things for most people. There was a time when I thought Newt Gingrich was a bad guy. Now I see a lot of my positions align with his.

I think Newt is the Thomas Jefferson of our time. I wish he was Trumps Chief if Staff.

I think we'd have several cases of spontaneous human combustion if he were to put Newt up in the cabinetry...

Yes....it would be awesome watching snowflakes melt.

He had a great solution to the 9th circuit court.....just dissolve it. The President has that authority. Cat replace the judges but can delete the court as not necessary. He understands the constitution and, as a history professor, he know history and has a profound understanding of what the founding fathers intended for how the republic should operate and the balances of power.

Rog, this is a moronic idea. Look, I cannot imagine how apoplectic you would be (and I would support you) if Obama had dissolved the 5th circuit (TX, LA, MS). These institutional guardrails keep out country from veering too far one direction or the other. If Trump was to do this, what would keep the next Dem prez (and this is going to happen) from blowing up a conservative circuit and on and on it would go until we are a true banana republic.

The 9th circuit is an activist court that is overturned more often than not. IDK if Newt was serious about doing that or if he was just saying what is a constitutionally legal way to get rid of an activist court. You are right though that it would set a dangerous precedent that would bite when the parties change....much like what happened when the dems went nuclear in the Senate and republicans returned the favor to get Gorsuch confirmed

The courts are pretty close to banana republic status already.  They don't interpret the law, they make rulings based on their political leanings.  When you have blatantly constitutional things repeatedly being overruled by a certain court they have lost the ability to be considered objective and ARE a banana republic.  Fortunately for America the chief justice was just caught being a perv and resigned and there's something like 20 openings on the 9th circuit for Trump to appoint.  It won't make it a conservative majority across the board, but it will help get it back to middle left at least.

You might not like the legal rulings but that does not mean they are not valid, and there is always a further appellate process - the absolute anthesis of a banana republic.

Of course the SCOTUS doesn’t ‘like’ 80% of the 9ths rulings.

But in the same regard, why do we care who makes it to the Supreme Court?  I mean, if they're just interpreting the law then it shouldn't matter if Obama or Trump appoints them.   However, you and I both know the law is "different" based on political bias and Obama's appointees will rule one way and Trump appointees will rule another way.
I've seen first hand how the court systems work in both criminal and civil proceedings and the law has very little to do with it, IMHO.  It's all about the personal whims of the particular judge that you get assigned or appellate system you run through.  Liberal activists know that they can push ridiculous cases through the 9th circuit and they'll almost always rule in their favor and then get turned over many months later.  They do this in order to get away with as much as they possibly can for as long as they can until the ultimate Supreme court shuts it down.  There should be consistency across the judiciary, but sadly I don't think it's possible, but we should weed out the really bad ones.

The difference in the judges is that conservative judges believe the constitution means exactly what it says and if you want to change the constitution then there is a mechanism to change it. Liberal judges believe the constitution is a ‘living document’ and it needs to be interpreted based on where society is now.

So liberals tend to appoint judges who share this paradigm. Conservatives tend to appoint judges who are strict ‘constitutionalists’.

Agree that liberals target liberal judges to try buy time. We saw this with Trump’s travel ban that, according to virtually all constructional scholars, was constitutional.

absolutely they do and you're correct at the reasons.  I guess what I'm trying to say is that it shouldn't be the case.  All courts should uphold the law period.  If the law is ambiguous to the point that judges cannot give it a consistent interpretation then the entire law should be struck down and re-written.

Why? The country is not at all uniform and why should the courts not reflect this. Would this be a better country if all of the federal appellate judges come form Nebraska? (Don't answer that...) Again, these are the guardrails that our society has developed, the road is just more than an inch wide, there is room for interpretation of the law.

Why? Because we are a constitutional repeblic and Congress makes the laws. It is the judiciary’s job to enforce the law. If the law is nebulous, it should be revised by Congress not interpret by a judge. It’s part of the balance of power. If individual judges interpret the law then the law is meaningless. Just my opinion....

Yes, but congress can write laws that are not perfect and can be challenged. This challenge is not based on "we don't like that law" but rather challenged on a constitutional basis such as violating civil liberties, or contrary to the first, second, third, etc amendment. It is because laws are often vague in places that makes it necessary to litigate constitutional issues not specifically covered in the law. Moreover, as congress has over the years yielded so much of their constitutional duties the the executive branch we see more and more challenges to executive orders.

Dude, doesn't your kid go to law school? Buy him a beer and have him explain con law to you.

And it's not the judiciary's job to enforce the laws, that is the duty of the executive branch. The judiciary is there to interpret law and safeguard our constitutional rights.

I guess I slept through 10th grade civics class....fortunately I never stop learning even if I am already educated beyond my intelligence.

I remember from English Lit 202 Sir Thomas Moore's take on the law in Utopia:

"They make as few laws as possible, and they criticize other nations that accumulate volume upon volume of legal literature, their reasoning being that a common man should not be tried under a body of laws so complicated that he cannot be acquainted with all of them or couched in such obscure legal parlance that he cannot understand them. They have no lawyers. Their policy is to have an accused person speak in his own defense. This saves time and the judge ordinarily arrives at the truth through questioning the defendant without the tricks of crafty prosecutors."

I guess we don't live in a Utopian society....

Which is probably why God gave Moses just 10 laws....in plain English...uh...Hebrew?....straight and to the point....but even that proved difficult so Jesus summed them up in just two, love God and love one another. (5 of the 10 commandments have to do with man's relationship with God and the other half have to do with man's relationship with one another)

Think I'd better hit the road.....starting to snow here in north Alabama....and one things Alabamians do NOT know how to do is drive on the snow. Maybe I will get the opportunity to pull someone out of a ditch with by badasz Raptor!! She is black and beautiful and a nice contrast to the snow.

 HA!!!

I would modify that to "someday I hope to live in a world where everybody just shuts the hell up".....and since I don't see that happening, I'm just going to head off to somewhere I can't hear anyone.  I still love my job and would never have another.....but honestly, listening to the same old, tired, "there's gonna be a revolution, you're all racists, blah, blah, blah" will probably push me out sooner than I had planned......I'm sick of listening to it.

I've held this job through 6 Presidencies, and 6 eras of opposition to the sitting President and DOJ.....and this is just off the charts for stupidity ON BOTH SIDES......so yeah, I hate 'em all.  LOL

Nah, it's too comical to get mad over....it's just exhausting to hear dumb c rap all day.

That’s a good attitude but I tend to vacillate between anger at the bias and SMH in disbelief at what has become of journalism.

My solace is the belief that eventually everything will eventually be exposed and a lot of commators will look like idiots. I LOVE the look on Joy whatshename’s face on MSNBC when Ann Coulter says DT will win the GOP nomination. The smug arrogance of the talking heads never ceases to amuse.

Oh, I also find it amusing when the networks have someone on that nobody has ever hear of and give them the title of “political analyst”. They are 20-something years old an think because they have a poly-sci degree their opinion matters.
