Two weeks notice- HR Question

I've heard that if you offer a two week notice and your employer tells you to leave that day, they still have to pay you for the two weeks you offered to stay. True? sounds untrue to me, just wondering though. My company has a history of walking people out the door the day they quit. |

Even a 5 year contact with a clause stating you must give 90 days notice or they must give you 90 days notice is really only a 3 month contract. The "2 week's notice" think is really just a social convention I think. Don't know. Only quit one job, but it was a retail store so I did the 2 week's notice deal and it worked fine for both of us, but my new employer wanted me to start that day and I told him I couldn't. |

I was told though that if they had you go ahead and leave they paid you for that time. They needed me to stay so I didn't have that little paid vacation. It could be on a company by company basis. I don't think I have ever heard any law about it. |

If you are going to a "competitor" most companies will walk you out as soon as you give notice. They'll pay you for the 2 weeks. If you have unpaid vacation, they'll usually make you take that before they just pay you to not be there. If this is your situation, have your desk already cleaned out and use up all of your vacation before you give notice. Some companies do this regardless. Others, if you are not going to a competitor and they need work done will try to accommodate you on the transition. |

If it was in the best interest of the company to have the employee leave that day, we always paid them for the 2 week notice; or whatever the agreed upon notice length was. We also paid for vacation or other PTO they had in the bank. Usually the only reason an employee was asked to leave that day was for I/T security. If they didn't have a sensitive job, it was better to have them stay and help with the transition. |

Here in Utah we are an "at will employment state" Which basically means they can fire you pretty much any time they want for any reason. The will probably pay you for two weeks, but don't have to. If your company has a history of being jerks, don't do them any favors by giving notice. |
