I smell a wreckless driving charge for this one...  I strongly feel that drivers must be held responsible for injuring others on the roads.   The runner must've been visible with the vest, but maybe should have been running against the direction of traffic (if allowed on the H-t-C relay) or wearing flashing red blinkies when on the state roads. 

I also wonder if there was shoulder on the roadside and if the runner was using it, or if the driver simply lost control of the car.  It's no excuse, but I hope that the police learn more about what actually happened prior to this tragic accident.
