Subject: Memphis is suing the NBA?

The Memphis City Council approved a resolution Tuesday asking the council's attorney to "explore all options" -- including a lawsuit against the NBA -- to recover revenue that may be lost due to the lockout.

Interesting concept I think, but I do not think it would work. I am not a lawyer, but I do no think they would be successful. Could you imagine if the NBA was sued by every city that had a team?

I wish Orlando would do that.  They forked out 500 Million to complete an new arena for the Magic a couple years ago.  They also got a promise of hosting the all star game this year, which probably won't happen.  If teams and the NBA intend to coerce cities into subsidizing their business, they should have a say in the negotiations.  Also I think the civic leaders who pushed these projects should go to jail.

Why is that? Do you think they had a crystal ball and knew what was going to happen?

I'm confused about this - wouldn't the team/arena/etc. have cancellation insurance?

I have always been dubious about using city/county money to pay for private industry, regardless of the supposed benefit economically, to the area. If the businesses want the teams run as a money making business for entertainment, let them put up all of the capital themselves, not rely on cities and taxes to pay for these new stadiums and sports facilities.

I am not sure if I support it or not. I mean they had no way to know the season would be partially cancelled. there are other events happening at the arena as well, so I do not know if canccellation insurance applies becasue they canlt agree on something.

I understand this sentiment. But I also used to work in economic development and incentives like these are not going to go away-- mostly due to the overall return on investment to the local economy. It's hard to argue with numbers, from their standpoint.

For some teams though (cough* Seattle Sonics *cough) I am not sure that it would have helped the Economy even if we had built a new arena for them. Maybe the local NBA fiasco here has made me pessemistic in general. I will say the at least our Soccer here in Seattle pays for itself over and over again even though they were not even around when the stadium was built.

I said that mostly in jest.  It is just that politicians paint rosey pictures with doctored numbers and use these projects to payoff political interest or enrich themselves.  Then there is good ol' fashioned legacy building which in times like these need to be put aside.  So no they shouldn't go to jail for building a stadium, but all the backroom deals and lies & exaggerations to the public if not illegal are definitely morally bankrupt.  But when an elected official does it, I guess that makes it ok.

Memphis as well as any other city/county/state knows - or should know - what business they are getting into. Anyone who followed basketball knew for years that there could be a work stoppage.

Recent history has the NFL, NHL, & MLB missing regular season games. Unless they have a clause in their contract that the NBA couldn't have a lockout or strike and then had financial remediation they have no case - Very Childish!!
