This statement/question: "if I were in my car backing out of my drive way and he hit me - wouldn't he be at fault?"  scares me.  She should have her driver's license revoked.

Too bad that any settlement is paid by the tv show.  So the worst thing that happens on the show is public humiliation (mostly on internet forums).
