I'm not sure how to feel about this.  On one hand, I don't think probation does a lot to curb other peoples actions (oh it doesn't matter if someone gets hurt, I'll just getprobation), but on the other hand, sticking a 91 yr old man in jail seems odd.  I don't think he should go unpunished but given he surrendered his license and is now in an assisted living facility, what is the purpose of the probation aside from a 'legal sentencing'?

That sucks! I don't care how old and frail he is. He was able to drive, get out of the car to assess damage, and drive away. That is criminal behavior, not excusable.

Also agree wholeheartedly.

I don't understand how it can even be pled down, from "Leaving the scene" to "attempted leaving". The f@!#$!@#$ left the scene. Got out, looked at broken bikes/people, and f'n left, then waited two days to say anything to anyone.

I was hoping there would actually be some precedence set with this.  Sort of like that woman that hit that kid and the woman had a BAC of .249.  At least she was charged with murder and got 14 years.  Not saying 14 years for murdue is suitable, but its better than 3 years probation.

Oh my last line on the OP was really question.  Is the probation doing anything besides making it look like the court system did something? So when he gets grumpy at his assisted living home and throws something at someone then he'll get in real trouble?  I don't get it.  Right now it feels like, oh he's old and senile so we'll just give him probation because he won't do anything?

lol you steal a bike and you get 3 years lock up. You run over a bunch of people and you get 3yrs probation.

Michael Vick got 2 years in prison for dog fighting.

Donte Stallworth got 30 DAYS in jail for DUI Manslaughter.

Sentencing in America makes not sense.

I'm not usually of this opinion, but since our State court couldn't seem to do "justice", I really hope the people he smashed into all file civil suits and are able to take him for everything he's worth. 

I'm willing to bet his "assisted living" is at a pretty nice facility.  Hopefully the civil suits will make him move to a more spartan place of care.  Call me vindictive, but that's what he deserves.

You all would seriously put a 91 year old man in jail for the rest of his life?  The guy won't ever be out on the road endangering himself or anyone else ever again, and he will spend the rest of his short years on the planet in a nursing home.  I understand punishing people for their crimes, but based on the little bit I know about this, it wasn't intentional, and it wasn't premeditated.  I don't think the guy was a criminal, just completely out of touch with reality.

I don't think the guy was a criminal, just completely out of touch with reality.

This isn't the act of a "confused" person.  This is the act of getting rid of evidence.

Leaving the scene of an accident is an intentional act. He mowed over a bunch of cyclists like they were bowling pins and then he took off.

That's just his defense attorney talking.  I wouldn't mind seeing the guy sued into the poorhouse personally, but I still think a 91 year old man with no criminal history doesn't deserve to spend the rest of his life in prison because he made one tragic mistake.  Even if it did ruin the life of at least one innocent person.

Ok, what if he was 25? Does he deserve it then? I have no doubt in my mind a younger persons sentence would have been severely worse than this guy got. I'm sorry, but I don't see how age has anything to do with what punishment you should receive for committing a crime, intensional or not. A friend of mine was recently called up for Jury duty, it was a cut and dry case, the guy was guilty... but one woman thought that since he was a minority and she believed they always seem to get the short end of the stick that they should should all say not-guilty. Thankfully the rest of the jury had enough sense to convict the guy, nobody should be given special treatment because of their race, their sex, or their age for that matter.It's simple. Are they guilty of the crime? If so, what is the appropriate punishment for the crime. I agree with most of the other people here, no matter how old you are you should be held accountable for your actions.

So, when the driver sues "on behalf of the cyclists" who gets the 25 Million?  I can't blame the cyclists and their families for going after the deeper pockets there, especially since based on that last article it sounds like the Deputy Sheriff wasn't doing what she was supposed to be doing at the time, and that the traffic hadn't been adequately blocked off.
