Subject: Starting business in Dallas, Texas - What Do I need?
I've been doing a little bit of freelance work (graphic/web design) on the side, and want to get a little more established as well as use a business name rather than my full name.  It would just be a sole proprietorship, not a LLC.

After a little bit of research, it looks like I would need to get a business license and file for a DBA.  Is this all I need?  How do I go about doing this?  What is the business license for exactly?  Do I need to get a business license if I'm just working from home and have no employees?  With a DBA, would I be able to deposit payments directly into my personal account, or do I have to create a business bank account?

Any other tips would be appreciated.  Thanks.

I'll see if I still have my file from when I set up shop in Texas back in the early 90's.  I set up an S-Corp but some other things may have been the same.

I probably will in the very near future, but I dont really want to spend the time/money to do that right now.  Isnt it like $500+ once it's all said and done?

I'm not sure.  I just know that there are certain legal and tax benefits to it.  I don't really know what they are but I'll ask around.  We have ~20something LLCs in Texas.  They're Delaware companies though for tax purposes. 

I guess I should look into that before giving some advice.

One idea is you can probably ask ACORN for advice.  There's a good thread on here about how ACORN helps all kinds of small businesses...Sorry, bad joke...

Ouch! If he wants to succeed in Dallas, stay away from the blondes. A quarterback down there had trouble finding success while dating a certain blonde.

Around here (Oregon) you need to file the DBA with the state and buy a city business license. The license doesn't DO anything. It is a tax here. Taxes provide services for the public (and endless entertainment for people to argue about). But you still have to have one to do business in the City.

If I were you, I would put on my Extreme Patience Cap and call some of the state and city government office and see what they say to do. Also, if you have a SCORE office in your area, they would likely be a very useful resource.

As a sole proprietorship, you pay taxes on any income and profits at your personal tax rate, if memory serves. Plus, you are solely and personally liable should any lawsuits follow. An LLC affords you some protection from personal liability and allows you to be taxed at a different rate. This is going off of memory from 3-4 years ago when I was thinking about buying my dads business in MA. I could be completely wrong.

Go to the Secretary of State site.  They have everything you need for setting up a business in TX.  You can do it all on line.  I don't know about the business license.
