Subject: So my wife was hit by a car...
Last night while she was out for a run with one of our dogs. Luckily it was low speed as the driver was making a left hand turn. I am not sure how he did not see her or the dog but considering he cut the corner it does not surprise me (if he had turned legally into his lane he would have completely missed her.) So far the doctor has said only soft tissue damage to her leg. No serious knee/hip injuries and no broken bones. If there is any lingering pain in a couple of weeks she will go back in to see if there is damage to any of the ligaments or tendons that were not evident under the swellin and bruising. She can walk ok (though stairs hurt) but has orders to RICE it. I also had her file a police report (via non emergency channels) so there is a records of it. At least the guy stopped and she got his information.

The only question I have is what now. Do we need to take any legal action against the guy? (would prefer not too as long as it remains no serious damage). Is there any follow-up on the police report that needs done?

(oh and the dog was fine )

wow!  I'm not sure about legal suggestions or what not - but I'm glad to hear everyone was ok...did she atleast do some damage to the POS's car??

Glad to hear she's OK. Do not sign anything waiving coverage from his insurance company. That's the first thing they tried to have my (now ex-) wife do when some dude hit her way back when. These injuries tend to last for a long time and if you sign off on anything you're basically saying they're not responsible.

Lawyers correct me if I'm wrong, but that's how I recall it going down.

i'm pretty sure his car insurance should cover everything, if you've filed a claim with them you shouldn't need to do anything else (unless it goes unpaid or is contested) unless you WANT to be classy and go on judge judy and sue?

Still waiting for all this guys insurance information to clear and come through. Once we do that we are going to have my insurance contact them to work out any payment for any additional work. I told her if she talks to the guy today at all not to even tell  him she is ok and not hurt. Leaving it open in case anything crops up in the next month or two that could be related to this.

I'm sure glad it wasn't worse, but still, just getting hit at a slow speed is something to be concerned about.

Only time will tell with the healing.

I don't know what to do about the legal action part and hope someone with experience can chime in.  Good luck.

You can contact her insurance company directly. Your own insurance carrier won't have any standing to contact the other guy's insurance carrier unless and until they make payments on your behalf. (Subrogation).

Now, I don't know what state you are in... but insurance laws vary wildly by state. I live and work in Illinois, so what I'm telling you really relates only to Illinois. I figure I've got a 1/50 shot of giving you the right advice, huh?

Anyway, contact her insurance carrier, see if they accept fault for the accident. Find out what your statute of limitations is as far as presenting an injury claim, and then wait a bit to see how your wife recovers. (Statute of limitations is the TIME LIMIT within which your claim must be settled, or a lawsuit must be filed) in Illinois, the statute is 2 years from the date of the accident.

Since she's likely in good shape, and nothing was broken, she will probably have a speedy and full recovery.

When you and she are convinced that she's recovered, and will not require further medical treatment,  contact the insurance carrier and find out if they are willing to pay your medical bills and offer compensation for pain and suffering. (She is entitled to collect this subjective amount under Illinois state law, your results may vary).

If the insurance carrier makes you an offer that covers the medical bills (or the full repayment of the medical bills, if they've been paid by another carrier... like health insurance) and also includes a reasonable amount for pain and suffering, and you are satisfied, then settle your claim. Settlement will involved the signing of a release that will absolve the driver and the insurance company of any further claims from your wife or you.

Remember if you hire an attorney, you will need to split the pot with him/her... including the money for the medical bills! So even if the gross settlement is more, the net to you might be less...

We definately do not want to sue unless her injuries are much worse than they appear right now after being seen by the doc and there is no other way to help. As a teach if she cant move around easily in a classroom or subdue kids (since she does special ed sometimes she does need to physically restrain a student to keep them from harming themselves or others.) it could be bad but we are hoping that is ultimate worst case scenario. Ideally no real injuries and she is back doing light runs in a few weeks again.

As to this post coming up as evidence, since I was not there at the accident everything I say is merely Heresay as me reporting what my wife told me and I would doubt that could really mean anything even if we had to file a large insurance claim or lawsuit and they found it. But still that is why no details on the location or names has been given

COJ indexes on google. You don't have to be a member to get into COJ, just be a member for it to be listed in the forum section.

New York Islanders defenceman Brendan Witt was hit by a car in Philadelphia on Tuesday, according to Newsday. But Witt reportedly picked himself up off the road and, after a few profanities, assured everyone he was all right before continuing on his way, prompting one witness to say, "it was like seeing Clint Eastwood, but in hockey."

Witt was crossing Arch Street to get a cup of coffee when a gold Yukon truck made an illegal turn and hit the 34-year-old. Newsday says Witt tried to jump on the hood of the vehicle before being thrown to the ground as he was struck.

"I'm okay," Witt told the crowd as he dusted himself off, according to Newsday. "I've got to go play some hockey. I'm a hockey player. I'm okay. No big deal."

"Boy that guy is tough," added the same witness, one of many who saw the event occur.

But the 6'2, 219-pound blueliner downplayed the incident.

We just went through this recently.  My Wife's had a minor injury from a rear-end collision.  I did a little research and found out that the typical lawsuit for minor injuries is 4 times the total medical cost.  I spoke with the insurance company after enough time had passed to be sure there were no lingering issues with her injuries and was able to negotiate that amount on my own. 

Turned out it was pretty easy and once I submitted my bills along with my expectations and a few conversations with an adjuster we got our money.
