Not if he has an agreement stating that it's his property (which according to his first post, he does).  How would this be different than pickup up the tools?  Does the paperwork specify each and every tool? No..

It's not like I'm suggesting he take her computer... He's taking his rightful property.

 

The way I read it in the OP, it's not clearly stated so by taking it you are risking a theft charge.  Sounds like the woman is crazy batsh!t insane enough to do it.

While the upset part of me does agree lol I think angry and vindictive is a better way to describe the situation so yes I could see her doing something like that.

My ex kept everything and by the time I got it back she'd given away my table saw, router table, compound miter saw, etc. I was all ready to make a huge stink but then thought better about it.

It's just stuff, it can be replaced. It wasn't worth starting another battle and having the kids see us go at it over material crap. Sometimes you make a sacrifice for the greater good.

I would argue that a tool box is merely a tool for storing tools.  Thus, by stating "tools" you are entitled to the box (or the 5k value).

What a crappy situation. I've been divorced for 6 years and just a few weeks ago picked up some lawn tools from my ex. I left stuff in her garage until I actually had a lawn. I am so glad I don't have "ex" drama.

That's tough. I contract lawer would screw you. You did probably need to say tools AND tool boxes. I think that you should fight. Don't just walk away, but I don't think you have a good case. Unless you have a better lawer and can argue that the toolbox is a tool itself. But in general, good tool boxes are sold as that, just tool boxes.

I have to agree with Kido here. A lawyer would easily make that argument. Don't agree with it, but I am willing to bet lawyer has probably never used or seen quality tools like you are describing.

Your revenge comes when you get chance to work on his car!

Fighting it costs money.  Is it worth the money?  Never go to court over principal only money.  Look at a cost benefit ratio here
