Subject: hit by car
so i was rocking today on my bike. feeling it despite the wind in my face. about 45 minutes in i am on the sidewalk about to cross the street. traffic has a red and all cars seemed to be stopped. I have slowed a little but after seeing everyone stopped at the red light i decide not to brake anymore and cross. the car closest to me decides to roll through the stop light and never sees me. I get hit pretty hard, wind up on the hood, and then get thrown toward the pavement. even the guy that ended up calling the police couldnt believe i landed on my feet. after turning down the ambulance and after waiting quite a bit for the cop i decide that i don't really care that much as long as the lady pays for a new rim because mine is shot. the cop comes out of the car and issues ME A TICKET. she said that i am at fault because i did not yield to the car because she had a turn on red sign. i am very confused because i was always taught that pedestrians have the right away. i am pissed off quite a bit, it could have been worse and i am thankful for that, but pissed none the less. anyone got some advice???

well, if you traveled thru a red light, against a car that had a green turn arrow, I'd say you were at fault.  We have to follow the rules of the road just like a car. 

That being said, I hope you're not too sore when you wake up tomorrow.

agree, agree. but the car had the red light. the traffic that i was riding next to had the green light, i was just on the sidewalk not the road. the car that hit me definitly had a red light but she was able to turn on red. thats i guess where i am confused.

Not to pour salt on the wound but you're not a pedestrian and in most places, a bicyclist is suppose to operate like a motor vehicle.  So, you shouldn't have been on the sidewalk and following the lights like a car.  I'm glad that you weren't hurt and I hope your bike gets fixed.

huh? a tix for you!! I am not fully comprehending this. Maybe you need to stop in the station and talk to some superiors to get a real explanation. I hope you have witnesses names and numbers to validate your story.

Sorry, but its very important that ALL cyclists know the laws because so much is at stake when we ride.  /rant

So which would discribe your accident, the green vehicles or red ones?

glad you are okay. if you are riding on the sidewalk, you are a ped. if you are on the road, you are a vehicle and need to obey the same rules (and then some). so, for example, when my daughter is riding her bike down the sidewalk, she is a ped. if i am training and riding 20 mph down the shoulder, i am a vehicle.

If you had been walking your bike through that intersection, you would have had the right of way.   Treat your car like a vehicle (it is!) and follow the rules of the road.

Ditto...here in GA, the law clearly states same - cyclists are considered motor vehicles...as others have noted, if you'd been walking the bike, the ticket most likely would've gone to the driver...as it stands, unfortunately, you were in the wrong...sorry to hear this happened to you and happy to hear you're OK.

Word to all cyclists - KNOW THE LAW IN YOUR STATE AS IT PERTAINS TO CYCLISTS...*most* states treat cyclists as vehicles; thus, at the very least, this means riding *with* traffic, on the road (not sidewalks) and obeying all stop signs, yield signs, lights, etc. just as you would if driving....

It sounds like the driver in this situation was probably concerned about oncoming vehicular traffic coming from their left and never expected a bike to cut across their path from the right.

The real lesson here is that you've got to ride defensively and always assume that drivers don't see you.  (One way that works is to make eye contact with the driver.) Car versus a bike is never a fair fight, no matter who is at fault.

Glad you're okay, but be careful.

Without knowing more specifics, I would suggest that based on what you said the cop was confused.  I would contact a local bike advocacy group ( try a local bike shop ).

I would also attempt to go to the PD and ask for more clarification on what you did wrong that resulted in you being hit *and* issued then being issued a ticket for it.  You may want to try contacting the village and asking them whether the path is intended for use as a bike path as well.

If the path is actually designated as a bike path, then I think you are in the right.  If it's like many of the paths in my neighborhood, and it's wider than a sidewalk, but no signs designating it's intended use, then you're in a gray area.

I'm not a lawyer, I just like to play on BT.
