Oh man...didn't we beat this to death (heh) in the Tookie Williams thread?

Against (in no particular order):

  • It's not a successful deterrant
  • We execute innocent people
  • It costs lots more to execute someone than it does to incarcerate them for life
  • Remember that "Thou shalt not kill" thing?

I am against capital punishment because I feel that nobody has the right, legal or otherwise, to take another's life.  I am not religious either, I just feel that life is too precious to be destroyed for whatever reason.  Some people do not deserve to live freely within our society but they should be kept in prison indefinitely, not put to death.

Unfortunately, what do you do with people who know that there won't be any real punishment for their transgressions? Think about it, life in prison, no parole. What's to keep someone from taking out their frustrations on another inmate or prison personnel?

I'm not against it, but I think that the family of the victim(s) should have the final say. Not that DA's office. I have worked a few 1st degree homicide cases where the defense tried to plea to life without parole. The DA's on those cases knowing it was a slam dunk chose the death penalty. The family on 2 of those cases had no idea how their loved one had been killed and had to sit through every detail of the crime during trial. One mom said it was bad enough to lose a child only to have to live through it again.

I am against it because I believe that killing people is wrong and that there is no exception to that rule. Whether it is Paul Bernardo doing the killing or a state appointed executioner the act - taking a life - is the same.

No.

Today, if they off another inmate, or particularly a staffer, they will most likely face the death penalty for that crime. That is some deterrent for at least some of the prison population. Take that off the table, and what are you going to do? Put them in prison?

Solitary? They will still have to interact with staffers some times. Also, solitary confinement may truely be a fate worse than death.

The guards are trained. They have weapons. Prisoners are restrained. When was the last time you heard about a prison guard being killed on the job, outside of a riot?

And I think your last sentence there is kinda proving my point.

I think John Paul II sums it up best in his encyclical EvangeliumVitae, The Gospel of Life.

56. This is the context in which to place the problem of the death penalty. On this matter there is a growing tendency, both in the Church and in civil society, to demand that it be applied in a very limited way or even that it be abolished completely.

The problem must be viewed in the context of a system of penal justice ever more in line with human dignity and thus, in the end, with God's plan for man and society.

The primary purpose of the punishment which society inflicts is "to redress the disorder caused by the offence".
Public authority must redress the violation of personal and social rights by imposing on the offender an adequate punishment for the crime, as a condition for the offender to regain the exercise of his or her freedom. In this way authority also fulfils the purpose of defending public order and ensuring people's safety, while at the same time offering the offender an incentive and help to change his or her behaviour and be rehabilitated.

It is clear that, for these purposes to be achieved, the nature and extent of the punishment must be carefully evaluated and decided upon, and ought not go to the extreme of executing the offender except in cases of absolute necessity: in other words, when it would not be possible otherwise to defend society. Today however, as a result of steady improvements in the organization of the penal system, such cases are very rare, if not practically non-existent.

In any event, the principle set forth in the new Catechism of the Catholic Church remains valid: "If bloodless means are sufficient to defend human lives against an aggressor and to protect public order and the safety of persons, public authority must limit itself to such means, because they better correspond to the concrete conditions of the common good and are more in conformity to the dignity of the human person".

If someone raped and murdered my 7 year old daughter, I would want him to die - I wouldn't care how it was done, but the mere thought that that person was sharing a joke with a cell mate, reading a magazine or a letter or even tasting food would be appaling to me. Forget about deterent or justice - that man would need to die.

I agree about how you'd feel. I'd feel exactly the same way. I'd probably want to take the guy out myself.

But that's a base instinct, and base instincts aren't good for society as a whole. If we metted out punishment in that manner, we'd do a whole lot worse to people that committed any crime. Ken Lay? Every Enron share holder should get 5 minutes alone with him with a club. For example.

As a society, we need to be better than that.

I'm conflicted on this issue myself.  Yes, if someone harmed one of my daugthers or my wife, the rage in me would probably call for that persons death.  However, just this morning, I heard about a case in Virginia where a man was put to death in 1992 for the rape and murder of his sister in law.  He proclaimed his innocence all the way to the death chamber.  Turns out there is some guy who has been bragging that he was actually the one who committed the crime and the governor has ordered DNA testing.  I just can't help but believe there have been innocent people put to death.  So I guess my problem might be more with how it is administered than the actual fact that a guilty person would be put to death.
