WaitingGuilty - 2011-02-09 7:01 PM The options are:

Triple face value refund plus ticket for next year (This is option fully transferable. IE they can get the triple refund check and then transfer their ticket to someone else next year, in other words, StubHub it and make additional profit, esp since Indy has far less seating for next year's game than Dallas)

OR

A package deal, non-transferable, for a ticket to any future SB game plus travel and lodging.

Totally fair, but I'd take option 2 in a heart beat.

As a diehard Redskins fan, I am no Jerry Jones fan, but this lawsuit is ridiculous. The NFL has made a good faith attempt to fix a mistake, but NOOOOOOOOO......Of course it's never good enough once the greed and the lawyers show up.

Mistakes happen...move on!

I agree here...3x the face value would not be fair compensation...but the future SB options are more than fair.  Especially the all-expense SB trip to ANY SB of your choosing?  Yeah, that is more than going to make up for your vacation time, travel, and expense of your Dallas trip.  I would join in the suit if the compensation was ONLY the cash, but I think the NFL did right here.

It does NOT replace the fact that some people did spend a huge amount of money to see THEIR teams play. I seriously considered it.  Judgments about the stupidity of such a thing aside, I would have been furious.  Time off work, flights, hotels, rental cars, and paying to see my team play (albeit badly) in the super bowl cannot be replaced with $2400 and next years game.

They need to make it the fan's choice to sell the ticket also.  You shouldnt just be a "guest".  I have no interest in seeing the Patriots play the Bears next year, I wanted to see the steelers.

ah, they changed it? before it was non-transferrable. Its better, but still doesn't replace memories.

He did say a decade or two. Beer pong teams don't last that long. Most don't last the weekend.

Gaarryy - 2011-02-09 6:52 PM So why are they suing the Dallas Cowboys and not the NFL?  which approved the seating plan or the safety inspectors/fire marshals that were working hand in hand with the NFL hoping they could get the support structure set correctly in time. And then told the NFL that the seats were not up to safety requirements.

I could see them suing the NFL, or Jerry Jones (since it's his stadium)  but not the Dallas Cowboys which play in Jerry Jones stadium.

?? they sued the cowboys, Jerry and the NFL accdg to the article.  Probably the cowboys since those with PSLs didn't get their seats?

I think what Gary's getting at is that the Cowboys and the stadium are separate entities both owned by Jerry Jones.  The team really has nothing to do with events at the stadium other than their own games.

Bingo..  Why not sue Blue star Imaging or other companies Jerry Jones owns that provided services to the Super Bowl.   And I was going off the espn story/interview where some of the people suing actually ended up with BETTER seats at the game than the ones they didn't get to use.  NFL network exec's and other people had to surrender their seats.   So people end up with better seats than the ones they purchased ( and I"m going with the therory that a 1500 seat is better than an 800 dollar seat. )  yet they are still suing.   That to me seems out of line.  It's like getting bumped to first class on a plane,  be given a couple of free flights for that trouble, then suing the airport where the plane took off for the airline bumping you to first class

The last story I read said the "better" seats line was completely bogus.  Most were moved to the highest levels possible.  I'm just too lazy to find the source right now.

I normally can't stand bogus lawsuits, but in this case I say sue away.  I know the NFL is a little different, and the 2 teams playing do have a history of being in the superbowl, but this game could have been a "once in a lifetime" oppurtunity for some folks.  I think of it this way: my favorite sport / team is Vanderiblt University men's hoops.  If they make the Final 4 one year, there's a good chance I'll shell out the time and $ and go.  But if I got there and they didn't have my seats?  I'd have probably been arrested then and there at the stadium.  Tickes to next year's event to see Uconn and Duke would NOT make me happy.  Not at all.

I'm just going by the two people I know that were "bumped" and ended up which the choice of being in a suite where the person using it wasn't going to have a big crowd and they were welcome to join their party or on the field.    And the other couple that had those higher seats that ended up sitting next to someone that works for the NFL since he had to give up his seats much lower due to the situation. And wasn't happy about it, complaining quite often.   Could there have been some whose seats were not as good, I'm sure there were. But., Are those the people that are suing?? I'm not sure.

My only point was you said they were suing the cowboys and not the NFL.  They are suing the NFL.

Anyway, it's a clas action (which I don't know if it could get certified, unless there are separate classes, i.e., those 400 that didn't get in, those that got replacement seats but were obstructed views, etc.)  As you admit though, you know two people that got better seats, but don't know if they are suing.  So I don't know how you can say people that got "better" seats are suing.  Maybe they are.  Maybe they aren't.  But neither you nor I can say that with knowledge.  And it doesn't apply to those that didn't get replacement seats

As for suing Jerry Jones, I don't know the corporate structure but I'm pretty sure he doesn't own the stadium.  He's likely president or CEO of a corp. that owns it.  Likely its the cowboys corporation that sells the PSLs, and the holders of the PSLs that got alternate seats are part of the class. We'd have to read the complaint to see what is being alleged

AS for the cowboys, the City of Arlington owns the stadium, but the Cowboys corporation operates it.  They aren't merely tenants

Different things are worth more to other people. I think its foolish to spend money on race wheels, new bikes, and coaching.  I'd prefer to go to a game with a team I have followed my entire life thanks to my grandfather. It has nothing to do with lots of money. I was going to use the pennies I have been saving for a year to get a computrainer and go to a superbowl.  I'm thankful I didn't....

its all about perspective and what is important to you.  Whether or not you would choose to do it or think its stupid is irrelevant.  The people got sold a bill of goods and it wasn't delivered.

That's the main thing. They bought a very scarce product, and it wasn't delivered. Personally, I can't imagine crossing the street to see a football game let along shelling out actual folding money, but other people do and they should get what they pay for. And if they get jerked around, then they should be compensated, and in this case the party responsible should be punished for gambling that maybe they'd have seats and selling them anyway. As another poster mentioned, $2400 doesn't punish the wrongdoer for intentionally screwing their customers. It's not even a slap on the wrist. More like an accidental bump on the shoulder. Selling tickets through the mail for seats that don't exist is actually a federal crime.

true that was my bad on typing

Anyway, it's a clas action (which I don't know if it could get certified, unless there are separate classes, i.e., those 400 that didn't get in, those that got replacement seats but were obstructed views, etc.)  As you admit though, you know two people that got better seats, but don't know if they are suing.

the people I know that got bumped are not suing,, the others that I don't know  I'm not sure of

So I don't know how you can say people that got "better" seats are suing.  Maybe they are.

ESPN interviewed  three people that were suing,, each one of the ones they interviewed admitted they did see the game from a better seat, but it was the principle of not being in the seat they bought that was upsetting them.. which is the mindset that I've been going from with my thoughts on the whole thing.  Could a bit of creative selection of interviewing though, since I would be shocked if ESPN did something to make their cash cow of the NFL upset.

Maybe they aren't.  But neither you nor I can say that with knowledge.  And it doesn't apply to those that didn't get replacement seats.
True if they didn't to see the game, while I might not agree with the suit personally given the attempt made to rectify it,  I can totally see why someone would go down that path, and feel they have every right to.

I"m betting there are so many layers that I'd get dizzy finding out

AS for the cowboys, the City of Arlington owns the stadium, but the Cowboys corporation operates it.  They aren't merely tenants.
I"m actually not sure, how it's done, when they have other events at the stadium outside of saying it's at Cowboys stadium, and the decor inside there is nothing Cowboys related to those events.  So if you went to a boxing match there and  the same seating thing happened I'd be curious if the Dallas Cowboys would be named in the suit.   It's a good thing for me to have fun googling on my next snow day though

Yes, it's a bit disturbing to me that people who are going to sit on juries say to themselves "well, that "X" you bought and parid for has no value to ME, i think you're stupid for buying it, I am not going to vote in your favor even if you didn't get what you paid for."

And that it's OK for people that can afford nicer things get screwed, just because they've got $?  So, if marmadaddy takes his massive BT profits, buys a Bugatti Veyron at $500,000, and they deliver an AMC Pacer, someone might say "sorry buddy, what a waste of your money"

that's a pretty selfish position, IMO
