The gun on my nightstand was giving me funny looks before I went to bed last night. And I am pretty sure it has some beef with my wife... Should I be worried? Not unless you're married to Mary Winkler... |

Actually, you are wrong on every account. The tgrigger guard was smashed in by the impact of the accident (likely on the break pedal bar) and caused the trigger to be depressed. That's the second time in my career I've seen/heard of it happening. The first time was when one bad guy was pistol whipping another bad guy......he cracked him in the forehead with a .38 revolver. It caved in the trigger guard when it hit his forehead and shot him in the shoulder when the weapon discharged. Both of these fall under not treating every weapon like it is loaded (Treat, rule 1). There are lots of ways outside of the "four rules" for a weapon to discharge. My dad was also a cop....he carried a .32 in his shirt pocket as a backup. he bent ove rin our garage one day and the gun fell out and landed on the hammer, barrel pointed straight up when it went off. he figures it missed his head by 1/2 inch....said he was looking down the barrel when it went off. We all ran out when we heard the shot after hearing his car pull in.....he looked like he had seen a ghost. Bold comments are mine. As far as the weapon that discharged in the auto accident after being damaged by the force of the accident that he didn't cause. Sorry......no. |

Master![]() ![]() ![]() ![]() ![]() ![]() | ![]() For the sake of clarity, you don't really need rule #1 (treat every gun as if it was loaded) I've never been able to figure out why they have it in there. It doesn't actually tell you what that means. "ok, so the guns loaded, now what?" It insinuates reference the the next 3. Kind of like the rules for your boss: 1) The boss is always right 2) if the boss is wrong, refer to rule #1.

The more I read the more I'm convinced that this is a battle cry, so to speak, for the purpose of supporting gun rights. Not that there's anything wrong with that, but I think it just redefines the common usage of accident.
No, there is better battle cries for supporting gun rights like "....from my cold dead hands" or the words written between amendment 1 and 3. Preaching about four rules just make use gun owners sound like hall monitors. I don't know if you are a gun owner, but when you make a decision to take ownership of a firearm or use a firearm you are obligating yourself to the highest level of responsibility you fellow man. You are assuring your fellow man that you understand that there is zero tolerance for f-ing up. Because the most minimal f-up can get some you care about a lot or even not so much killed, period. Responsible gun owners, and there are examples of them in this thread, have no tolerance for anything less than 100% attention to safe handling of firearms. That is why anything less is not an accident, it is in fact negligence. It has nothing to do with gun rights (well other than avoiding bad pr) and everything to do with understanding personal responsibility.

Which affirms my belief that we should better regulate who is and who isn't allowed to own a firearm. Further, I believe that anybody who shoots somebody without intending to is negligent because they were unable to follow four infallible rules and therefore can be held criminally and financially liable. mr2tony - 2013-02-14 12:58 PM I actually agree that there are no accidents when handling a gun, based on those rules. Yet people get shot without the shooter actually intending to shoot them all the time. Which is why I am firmly for more gun control, to keep guns out of the hands of stupid people who can't follow four simple rules. Then the weapon was pointed at something they did not intend to shoot. Therefore, a violation of the 4 safety rules. These rules are virtually infallible. This country is filled with a lot of a-holes and stupid people. That still doesn't mean we should take away their right of citizenship without due process. Edited by Jackemy1 2013-02-14 4:25 PM |

I agree with just about everything you wrote. However, anything less is not, in fact or per se, negligence. It's just not. You are establishing a construct that makes an accident impossible if certain rules are followed. That is not the definition of an accident. As I mentioned, an accident can certainly be negligent. You seem to assume these terms are mutually exclusive.

In regards to gun ownership, I do. If someone gets unintentionally injured or killed with my guns for what ever reason and in any manor I am negligent. The day I don't understand that it the day I should no longer be a gun owner. In other things in life I am actually a pretty fun laid back guy who is quick to give the benefit of the doubt.

However, that has nothing to do with the definition of accident. |

First off, I agree with pretty much everything you've written in here and I do wish more gun owners were like you. Now, I never said we should take away anybody's right to citizenship without due process. It's the `due process' part where we disagree. Restrictions on Constitutional rights are not unique to the Second Amendment nor should the Second Amendment be free of any restrictions. |

I have a belief that we should better regulate who is and isn't allowed to freely speak their mind. So? What follows from that? Nothing! Whether you like it or not, we have this thing called the Consitution and the Bill of Rights. If you don't like it, amend it. But don't ignore it. Hugs and kisses (since this if Valentines Day) JC |

I didn't shoot my girlfriend last night! Keep your guns, fire away, continue with the threatening rhetoric to would be intruders if it makes you feel safer. For every anecdote you can find me about an intruder that murdered the occupants, I can find you 100,000 otherwise. Decaf perhaps? If you actually want to know the answer... for me personally... no, property theft is not a capital crime, nor should it be. It's just an object. If I ever thought deadly force was needed, I- me personally, would truly have to think my life was in danger. Merely being in my house with my DVD player in your hands does not count. But the problem with life and death situations is that sometimes you do not have much time to make your decision, and sometimes you decide too late. The state of Colorado has entrusted me with the ability to use deadly force in my home. I happen to agree with that. I pray I never need to, and statistics and my own personal history tell me it is next to impossible I ever will. I'm good with that. I was being light hearted but I've noticed before that we may not share the same sense of humour. Which is fine of course. I like your response though and perhaps surprisingly, agree with every word. Despite all our bravado, it must be very difficult to carry the weight of taking a life even when it is completely justified. Well that's a shame. I'm a big fan of dry, and you can never have enough sarcasm... but it's all completely lost on the internet. I'm not a big fan of internet bravado, and I can't stand endless "what ifs" by pro gun folks where a gun is the ultimate trump card and assures you of only positive outcomes in every possible bad situation. I personally could not comprehend taking somones life. Not saying I couldn't under certain circumstances... but I imagine it would be quite traumatic to me. At the end of the day, I don't want someone dead... I just don't want them in my house. If they are in my house, I just want them gone. If a DVD player goes with them, I'm OK with that. If me and my family are unharmed, that's all that matters. And if it is the police showing up that gets the job done, I'm good with that too. I just want options. |
