2 questions

- how can one "legally" be fired for personal reasons (assuming there have been no problems or complaints due to the personal issues)?

- are ALL porn actors "stars"?

Look on the bright side.  At least he's got more free time to, uh, keep her in practice!

They say he did nothing wrong, and yet a quote in the article is given as:

"When you become a public figure you are held to a different level of scrutiny and ethics," Babcock said.

Now this would imply that there WAS an actual cause for the firing, which would be, what, an ethics violation? Obviously these people don't want to ADMIT that they're screwing this guy over in a royal way, and I think he's got all KINDS of legal ammunition.

Yeah, how come they always say porn STARS? Aren't there lots of just run of the mill porn ACTORS? And what makes you a star, anyway?

Depends on whether Florida has at-will employment and whether those laws govern municipal employees (I assume that's what he was)? At least in California, different laws apply to private companies and government-type employers (ummmm ... I think). At-will, you can fire someone for not liking their shoes. Or whatever.

I dated a porn actor. I thought about marrying him for about 5 minutes. He's still a good friend, but he's all legit now--manages a fleet rental company (usually for movie sets) and is married with a kid on the way.

Does this mean that IF you get fired you should then marry a porn star?

I'm sure his contract was "at-will" meaning they can fire you for any reason... or no reason at all. Also I would bet the severance pay agreement has a "no-sue" clause in it... in effect, if you take this money, you agree not to sue.

Most states have at-will employment, but you can still sue and win for being fired for no reason, usually.  The article does say his contract had a clause in it that he could be fired with a majority vote from the board...not that I think it's legit, but they voted unanimously to fire him so they don't particularly need a reason.

Spokes - 2009-07-23 1:10 PM I would think that the city would think it was great, as porn does contribute a lot to the Florida economy, and I mean for local politicians its all about economic development, right?

I hope he sues the poo out of them and gets a few pounds of flesh in addition to the financial settlement. Its not like he's married to a cousin of Osama Bin Laden.

Did you intend that pun?

This is a strange, strange article.

This is strange. If the guy was doing a good job and I lived there, I would let my board of prudes know they went over the line. Who cares what the wife did or still does? It hasn't been a problem yet and probably never would have been.

I know texas is what is called a "right to work state"  meaning either side employee or employer can quit or fired without notice or cause.

I think this is odd,, since they have told him the reason he is/was getting fired was  only because of who he chose to marry.    If they would have just fired him and not given a reason they could easily deny why they fired him.

I really think it's funny that they were married a few months before anyone found out,,how did they find out... did someone go home turn on their computer and says... " hey!!!! that's ______________wife"

Social conservatives are notorious for 'do as I say, not as I do' when it comes to ethics & morality. And before somebody says it, yes everyone is a hypocrite about something. This is just the area in which they excel at hypocrisy.
