Subject: TriAmerica Miami Race that was cancelled back in Oct.

Okay, so I've been contacting Sommer Sports since October, trying to get my $70 back, which obviously, has not happened yet. I have called probably twice a week since Oct., and gotten no answer from ANYONE.

 Has anyone else been refunded their money from this race? I finally emailed them and threatened legal action (ok maybe I was bluffing a bit, but hey, I'm a student, 70 bucks is a lot to me). I got a response the next day from the secretary and they asked me if I wanted my money to be put towards a future race with them. No thanks, I am done with this race company. She said she forwarded my info to the CFO- that she can't help  me with this situation...ugh , SO FRUSTRATING!

Do you think I'm being unreasonable here?

Not at all.  I once spent 8 months trying to get $80 back from PayPal.  It had nothing to do with the money, I just hate being taken advantage of.  Oddly enough, all of the accounts I used with them have now been blacklisted.  Eventually my bank saw things my way and refunded me the money.  Haven't used PayPal since.  A$$holes.

Nope, not unreasonable at all.  You payed for a "service" (sort of) that was never provided.  They owe you your money back.

I'm going to disagree here. You pays your money and you takes your chances, a lot of races have that or a similar disclaimer on the app.

From a guy who had four races cancelled in September and October, got fees back from only one. That was a small double century run by the LBS owner who I know personally.

I can understand the disclaimer being there, but that's pretty uncool to do (couldn't think of the right way to put it).  That seems like someone is literally stealing money to me.  Like if you win an Ebay auction and pay your money, but the product is never delivered.  The seller says something like "turns out it was stolen property, had to return it to the original owner"  and then doesn't refund your money.  You didn't pay for a chance to receive propery, you paid for property.  If you didn't receive that property they should have no right to keep that money.  The same for the race.  You paid to race, not to have it canceled.

I know there are disclaimers and other legal stuff that make this okay in the eyes of the law, but in my opinion it doesn't win return customers and isn't right from a moral (mine, I know) standpoint. Okay, I'm done whining.

Yeah...but this race was cancelled because the director lost his permit, not an act of God type of thing. If the RD cna't provide what was promised, he or she should do the right thing.
 
Regardless, ignoring their customers is bad, bad.

This isn't comparable as it wasn't cancelled due to an Act of God. It was cancelled because the race director wasn't able to acquire the necessary road use permits so the city denied the event application.

There may have been language on the race application that covered this contingency. Also, I know zip about the permitting involved although I assume it's fairly Byzantine. I don't envy the race companies position.

Personally, I expect that when someone takes my money for a service, they are guaranteeing me that they have taken reasonable efforts to ensure that they are able to deliver the service. That includes permitting and licensure.  I don't hire an electrician because they figure they have a pretty good chance to get an electricians license. If a contractor isn't able to get a building permit that they've stated they will get for work I've contracted them to do, I expect any deposit to be refunded. Maybe the economics and timelines involved with putting on a triathlon make that impossible here. I don't know.

Also, in their letter to her the race company stated: "As a registered participant you will receive full credit for this race."

Depends on how you define "full credit", and what was on the race application I suppose.

Exactly- on the letter I got sent to me, the morning of the race that was cancelled, it said full credit would be given. I guess if they still refuse to give me the 70 bones back, I would take a credit towards another race. But, right now- it's really just about the principle!

Never said it was right, just that that's the way it is. They are offering you full credit on future races, that's probably enough to appease any court. Sure it doesn't bode well for goodwill and customer relationships, but I get the impression this company isn't overly concerned about that department.

I did a bunch of Sommersports races this summer, and will probably do a few this coming year also. They're probably the cheapest in FL, especially if you buy a package. One of the sprints in Clermont was cancelled, and I took the money and put it toward the FL Challenge Half.

Now, the sprint was cancelled because of one of the hurricanes, not a permitting issue. You've got a little more going for you, sounds like.

From my experience and watching other people's interaction with them on their web site, I think they will stall you as long as possible to try and get you to take the credit toward a future race. I don't think Fred's a bad guy, but he's not very responsive to email and they flat don't want to give refunds.

For reference, Tri Blue Sky, who puts on the Tri the Parks series here in GA, cancelled their first-ever race in Florida that was scheduled for a couple weeks after Katrina hit. They sent out a prompt e-mail notifying us of the decision, and without even asking, sent refund checks within a month.
