If you are in a crowded theater, most of the theater go-ers have smartphones, follow-you on a social media platform and then you "tweet" the word fire - is that protected speech?

In other words, can you tweet "fire" in a crowded theater?

Is there a fire in the theater?   No?  Then this is not protected speech.  

Did you cause a trampling riot?   No?   Then it probably doesn't matter, you're not going to get charged with anything.

1) Why would you want to?

2) I am not an expert on all smartphones, but the twitter app I use on my iphone I actually have to have open to get messages. If it is in my pocket and I'm not paying attention to it I see nothing. If I was in the theater in that situation I may not see your tweet until hours later.

i turn mine off, but i don't go anymore because too many people are texting and taking phone calls the whole time, it's just not worth it.

Haven't been to the movies in a while, but why would people pay to see a movie and then text?
You can text for free outside the theatre.
I guess some peoples thoughts are just THAT important.
