From that stand point we have come to an agreement on all monetary things. I have given her more then the fair share of items.

But she is getting no alimony.

You can't file for divorce for 1 year from separation. unless you are physically, mentally abusive or you get caught cheating.

Technically I understand that having a relation in the first year could mean cheating.

Then she could file for divorce and go after more if she wanted. I don't think that would be the case she can't afford a lawyer. And recently racked up $10,000 in debt on her own that does not have my name attached to it.

And in NJ there is no legal separation; you're either married or divorced. Turns out a lot of people file under grounds of "extreme mental cruelty" and the courts are pretty liberal with what that constitutes. Sort of a work around for the lack of no-fault. 

Wish I would have got divorced in NJ. In CA it is truly a no fault state and cheating or cruelty doesn't mean jack.

So does this mean if one party decides its over then its over and all your sh*t gets split 50/50 no matter what?

Community property states ...doesn't mean 50/50...it's what is equitable. I divorced in AZ community property state ...just filed irreconcilable differences ..settled it through collaborative lawyers ...stuff was split equitably. Over in 7 months from start to finish.

We were able to come to an agreement over property and money but only with the help of lawyers and a mediator (on her part) but we were both legally equal in the eyes of the law. The house, money, and whatever else that was achieved while married was legally 50/50.

What I was really getting at was the notion that what leads to the divorce doesn't impact the division of 'stuff.' Seems like it could create some pretty unfair situations but probably works out best for the majority. Lucky for me I don't see this being something I need to worry about.

why should it??  like teej said, equitable division makes sense.  my marriage certificate says nothing about fidelity, lying, being a nag, etc.  my religious rites and vows declared otherwise, but as far as the state/law is concerned, how on earth do they even begin to write guidelines for every possible scenario?

In CA it does not matter at all unless it's something that would but one of the people in danger for their life.

In my case it was based on many things. We had a lot to distribute. Money, many many properties, a business and stuff. It was not 50/50. I could have received more but I just wanted what was fair ...mostly to do with the business since I was being "fired" and he was keeping it. It's a misconception that its split down the middle. Some stuff yes. Other stuff no.


TJ....we're over this....we're onto shaving and switching sides.....
