Subject: RE: ARE YOU KIDDING ME!??!

What a hilarious thread.  Didn't realize we had so many whiners on BT.  If you break the law and happen to come upon a cop that decides to ticket you for it, HTFU.  It's all well and good to come here and say "bummer, i got ticketed, that sucks."  To say "i broke the law, give me a way to get out of it...."...........................

When I cme to a stop sign, I look around to see if any cops are visible, if they are, I stop and unclip.  If not, I go through.  If I get a ticket, I wil certainly know what it is for.  I won't be happy, but there's only one person responsible for it: me

I am not sure how anyone can make a statement like "they didn't use common sense," "they're having a bad day,"  "their wife didn't give them sex...."  Maybe there have been accidents and they're raising awareness and the OP was the victim of that.  Maybe the local residents are sick of roadies in huge packs blasting through stop signs and holding up traffic.   Maybe this, maybe that.  No one has a clue why the ticket was given rather than a warning.

Bottom line, ticket was given.  Suck it up

"The law is the law" - meaning the police officer totally had the right to pull you over and give you a ticket.

Personally, I think it is complete BS that you were ticketed. I joke with my training buddies about getting a speeding ticket on my bike. I have read about people getting them.

The part that makes it the hardest is that police officers generally are busy enforcing more pertinent infractions (crime, public safety, coffee and donut investigations) than cracking down on cyclists. Chances are high that someone had recently phoned a complaint about cyclists in that area.

The best thing you can do is to make sure you are aware of the laws in your area - every time you break a law, be aware of the potential consequences.

I view any driving/cycling pull over threat as something that is only a matter of time until I experience it. I am a conservative driver/cyclist but it is the way the system is set up - mistakes are easy to make and a cop could pull over anyone they want to after following them for a few blocks. For those law-sticklers out there, who do you think knows the rules better? The guy getting puller over or the guy who has to be able to justify pulling you over?

Gaarryy - 2008-04-27 11:41 AM I never take my license with me while I'm biking.. since I'm not driving a car I figure I don't need it. I see 8y/o blowing stop signs all the time in front of police cars in my neighborhood and I'd be amazed if they are being pulled over for a ticket.
My friend was taken to jail for not having ID while speeding on his bike...that's right, jail. Now, he did tell the cop to do his job and stop a real criminal (considering cars on that road go 10-20 mph all the time). They put his litespeed bike in the trunk, and took him to the bighouse. The charges were all dropped, but he spent 5 hours in the pokey in spandex shorts! My wife and I have both been pulled over for "rolling" stop signs...sorry rule sticklers, but I think it total BS.

OMG they took him to JAIL???? what state???

I have my roadID and cell phone and that is it these days....if they don't like that guess I will be in jail for a long time!

California...absolutely true story. We couldn't get him out for 5 hours as he went through the booking process. it was HORSE$SHOOT. They took him to the jail for suspicion fo providing a false identification despite the fact they verified his mailing address on his license. It was really for, "talking back to a bada$$ lawman who was teaching him a lesson."

No one said he has to like it.  It's the b1tch1ng and moaning about how it's so unfair and the cop should be catching real criminals and how do I get out of it.  that's far different than "man, I am pissed cuz I got a ticket."

Maybe the OP should pull a Rev. Al and Shut The City Down.  After all, rights violations are rights violations.

Been watching this thread for a while now and I have to say to the OP:

If you choose to follow laws only when it is convenient, don't be suprised when the risks your taking yields less than desireable results.

My concern from reading all of this is that it seems to give the impression that there is somehow something wrong with the Police Officer doing his sworn duty and that it is somehow OK for us all (As Cyclists) to break the law when it is inconvenient to follow them.

Under the best of circumstances, we are totally invisible to the motoring public. Running through stop signs and red lights is no different in the eyes of the law than doing it in a car. (But obviously way more dangerous since it is an unseen car that is gonna take you out)

One of my training partners was hit by a car while out training two weeks ago and spent a week in the hospital and is non-weightbearing for the better part of 6 months, She did CdA and Kona last year and was training hard to make it back to Kona this year. Now will be lucky to be walking by that time.

The car that hit her did come to a full and complete stop before proceding through and hitting her broadside. (And so was not issued a citation) He just did not see her and I guess they deemed it an accident.

IMHO tragedies like this are all too common under the best of circumstances but are all that much worse when they could have been avoided.

Let's please all try to do our best to keep from becoming a "Memorial Thread" stuck to the top of the BT Forum...

We don't follow the same laws. We do not require a driver's license. We cannot go on interstate highways in most states. We are not allowed to drive in the left lane in most cases. Bicycles also weigh much less than cars. If we screw up on the road, the primary risk is to ourselves.

I am not defending blowing through stop signs, and definitely not in areas with traffic. However, I think people have to recognize that cyclists are different. I don't think it is unreasonable to expect that a ticket on a bicycle should not affect your driving record in the same way as a ticket in a car.

Break the law, cop has the right to ticket you. Don't like the law, write your state legislator and complain about it. Sheesh.

Just thought of this point against not getting tickets (even though I think it is still fair to ticket cyclist)...  Don't most roads have a minimum speed and if you can't maintain that you can't be on it?  I am pretty sure when I am riding the shoulder of a street with a 60mph speed limit I am below the minimum.  The problem with ticketing cyclist there are area's where most of us would think there are some gray area's we should be able to slide.  The only way to really get rid of the gray area's is to change the laws to state that track stands are okay or you must slow to Xmph at stop signs.

I think streets only have minimums if the minimum is posted (like on highways).

Not stopping at a stop sign isn't really a grey area--either you stopped or you didn't. Grey areas are statutes like "too fast for conditions" or "wreckless endangerment". Those things are pretty subjective; failing to stop isn't.

Pretty much the only roads with posted minimum speeds are interstate highways. Bicycles are not allowed on these roads.

The car-based society needs more exposure to seeing cyclists on the roads during peak hours, and I think they will in the next few years.

If those people would see what it is like to ride on roads with all those awful momentum-killing traffic control measures, they might start to change their thinking. Kinda like the way motorcyclicsts get to lane split and move to the front at stoplights in some European countries.

I've fractured a few laws in my time and it usually take a while before I get to the "well, I guess I had that coming to me" stage.  It's kinda like the 4 stages of grief: anger, disbelief, sadness, acceptance.  Or something to that effect.

OK, new BT rule....no whining!  Accept the cold, hard facts of life.....

Next time I see some whining here, I'm gonna  throw the BS flag.

Gotta run.  (gotta go buy a bunch of flags!)

Cheers.  :-

Here in Idaho we have it a little easier than most states we are allowed to role up to a stop sign and if clear or after yielding the right of way we can continue on.  Also for red lights we can continue on after a complete stop.  I can usually beat traffic from light to light in my commute to and from work.  Out in the farm land we don't even have to stop for the stop signs when there are no cross traffic just keep on going.

I've already posted my thoughts, but will add this...If it were me getting the exact same ticket in my car, I'd likely post as the orig. poster did...I'd just do it on COJ. Even then, I think there can be judgements made by the cop to just ignore the minor offense. (and obviously there are, otherwise there would be 50 cars lined up on every road getting tix pulled over for legitimate infractions)
I dont want to get special treatment....just hope to avoid the cop having a bad day who decides to ticket me for rolling thru a stop sign after ignoring the dozens of drivers that drive around on dark days when the rain is POURING down and visibility is terrible with no headlights (My biggest gripe)...NOW THAT IS DANGEROUS...but i guess the rain is a bit much and they can't get out of the patrol car....
