Glad I saw this.  I just did a one loop on the IM Moo course today.  Luckily, no cops were around.  I better watch out.

wow. cops here don't even stop cars for not stopping at stop signs. heck, cops don't even stop at em. However, nearly everyone will stop at a yield sign, even if there is no traffic what so ever ... There was a cop parked near our house yesterday near a stop sign and not one person turning right stopped at the sign and the cop did nothing. All cousins ya bra? But eh, kimo, wear 'em dem seatbelts brahda.

I wish that cop would come to Isla Vista (where UC Santa Barbara is) and pull over the hundreds of people on bikes who can be found completely disregarding all traffic laws at any given time of day.  I work nearby and go there to have lunch sometimes.  Seriously, each time I go to IV I literally have to dodge at least 20 people on beach cruisers, talking on their cell phones, blowing through stop signs, completely ignoring all cars, pedestrians, and other bicyclists.

I was stopped for this same infraction, although, I did come to a complete stop. Only didn't unclip or put a foot down. I actually waited for another car to go through the intersection, then proceeded. the officer was right behind me in line and pulled me over on the there side for failure to come to a complete stop. I ended up arguing with him. (I was 19 and thought I knew everything!), he called his supervisor, who ended up driving to the scene. I had to prove I could sit stationary for a full three seconds with my feet on the pedals, then proceed. Once I did the track stand for 3 seconds in front of the supervisor, he let me go with a verbal warning.

I never take my license with me while I'm biking.. since I'm not driving a car I figure I don't need it.  I see 8y/o blowing stop signs all the time in front of police cars in my neighborhood and I'd be amazed if they are being pulled over for a ticket.


My friend was taken to jail for not having ID while speeding on his bike...that's right, jail. Now, he did tell the cop to do his job and stop a real criminal (considering cars on that road go 10-20 mph all the time). They put his litespeed bike in the trunk, and took him to the bighouse. The charges were all dropped, but he spent 5 hours in the pokey in spandex shorts!

My wife and I have both been pulled over for "rolling" stop signs...sorry rule sticklers, but I think it total BS.

I haven't read any other replies on this thread, so this may have already been mentioned...

I'm guessing this happened on Mercer island... It started about 2 years ago... The locals have gotten what amounts to a petition to the local police to be more than anal against cyclists. There are a lot of team rides that go around the island every week, and take over the entire road. And to an extent I can see their point. But they're ticketing for riding 2 abreast, failure to stop, etc. any time they can.

But I believe the letter of the law regarding 2-wheeled vehicles is that you must put a foot down for it to be a legal stop. Track stand doesn't cut it legally, even if you're rock solid at it.

Word to the wise regarding Mercer Island -- avoid it if you can, be above reproach if you can't.

Well, since we (cyclists) are on the road, in CA atleast, we have to obey the laws of traffic.  So getting the ticket validates our right to be on the road . . .

the ticket is stupid....and the cop

a) is a lard A$$ and it was written in spite
b) is a newbie with badge-itis
c) just had a fight with his wife (who likes to ride bikes)
d) all of the above to go along with no sense of the fine line that is all throughout the legal system.

To those who say, 'well, you DID break the law', I don't disagree. But do all of you come to a complete, wheels stopped, STOP at every stop sign? Even the ones in the neighborhood with no traffic? If not, the responses need to be withheld.

Me? My view on stop signs. I stop when there is traffic around and don't stop completely when there is no traffic....on my bike, unless it is a busy intersection, I don't even lower the cadence. (but my riding is done in a very isolated place, and I may see 10 cars in 2 hours of riding)

Your right. I couldn't whine to the cop, so I thought that I complain after the fact, to fellow BT folks. I am not looking for sympathy. Sometimes you need to be able to "WHINE" just because. I don't need/want a hug from anyone, but I was looking for some advice on how to save myself from a moving violation, and spending $125.

Bryancd, it seems that you are perfect, and do no wrong, so at this point it think we should agree to disagree.

FOr this reason, I have generally stopped taking my drivers license with me on bike rides. I have  RoadID, and also take my work ID and a credit card. But, I figure that without the drivers license, it is unlikely that they would go go the trouble of writing a ticket - and if they did, it is extremely unlikely that the state/city would ever find me again in order to collect their money.

I blew a stop sign a couple of weeks ago, and I mean I never slowed down, and I glanced to my right as I went through the intersection, and there was a copper hanging out. I unplugged my left headphone (yes, I ride with headphones on certain parts of my ride--save your comments) so I could hear the dude blip me with the siren...to my surprise nothing. At least that day, the cops had better things to do.

For those of you who say just suck it up, quit whining, etc...I'm sure you wouldn't object to getting a ticket for going three miles over the speed limit then. "Sorry sir, that was 28 in a 25 ... gonna have to write you up."

If you blow a sign...a ticket is probably deserved depending on the conditions (i.e. country road v. city), but "rolling" a sign is a freaking joke. I will never clip out and put my foot down at a stop sign unless there is traffic. Loser cop having a bad day.

Sorry dude, at least its only $125, in CA that's now $360.

Sucks, but it is the law, end of story.  Yes, chances are the cop who did it either didn't like cyclist or needed to hit his quota.  But if you run a stop sign/red light on a bike you broke the law.  If cyclist want respect from cars we need to respect the laws cars are going to follow.  Now granted us following the laws is not going to change the opinions of drivers but they are still the law.  I know someone mentioned that this is law is basically protecting ourselves from being stupid.  I take this as if I run a red light and get hit by a car and die it only hurts me?  What about the poor guy/girl who hit and killed me or my family who I just abandoned.  No this does not protect just me but others, sorry.

No I don't agree with the fact that track stands don't count as stopping but that is the law.  There are just too many groups I have seen blow through signs in big packs that I don't blame cops sometimes. 

I do believe some laws should be changed but until they are I will either follow the law or accept responsibility for my actions.  I won't show up in court hoping the office does not unless I feel I was given a ticket for something I did not do. 

IMO, officers should look at the the situation.  If the bike was in the middle of nowhere and slowed down and there was no car within .5 miles of a 4 way stop then, no ticket.  Or if a bike goes through a red light at a t-interstection where they are gong straight no ticket.  But until this is changed so be the law.

WA has a defered period of a year and you can only do it once every 7 years and you pay the ticket and a probation fee. Also its the end of the month so he probably had to meet his quota and thought easy ticket.

Oh, and I don't buy the "would you argue if you got a ticket for going 1mph over the speed limit in a car" as a defense.  IMO, they are 2 different things.  On a bike a complete stop is generally considered unclipping and putting a foot down, period.  In a car you speed-o-meter could be off slightly so even though you car showed 25 the digital speed gun the cop has could show 26mph thus most cops generally give at least 5mph but if you get ticketed for 6, hey, pay the fine and go on about your day.

Interesting - so did he actually find you in the computer? (your address, DL number, etc?)

I also figure I am 'safe' because my drivers license is from a different state than I am currently in (I'm in school). Also, I have a rather common name.

So the next time you come to an intersection and a car slowly rolls through the stop sign NOT seeing you and you ram into side of the vehicle, even though you had the ROW, that car should NOT get a ticket? right?
NO the car should get a ticket for failing to stop or even failing to yield just like a cyclist should get a ticket for breaking the law. If we want the same rights to the road as a motor vehicle then we need to accept the consequences of breaking the law.

two different things? they are totally comparable. Both are breaking the law. Driving 1mph over and rolling through a stop sign. Shouldn't a driver be responsible for making sure his car is performing correctly and the speedometer is accurate? Ok, so they give you 5 over...
People drive 6 over all the time and don't get tickets. If I got a ticket for going 76 on I75, I'd be on here complaining!!! Same with the stop sign. There is running a stop sign, then there is RUNNING A STOP SIGN aka blowing through it.... Everyone here, to some degree, regularly breaks a law driving and would be ticked off if their normal (illegal) habit cost them 125 bucks....(I think that is the spirit of the OP)

I agree that running a stop sign and RUNNING a STOP SIGN are totally different and this cop probably was having a bad day.  However, my point with 1 mph of the speed limit is unless you have a digital speedometer which I have never had distingquishing between 25 and 26 is practically impossible and that is why you generally get a little leeway.  Yes, 5mph over is a 20 is alot worse than 5 over in a 70 and I think most cops give leeway but they don't have to.

I thought I saw on a previous thread that some states require a foot on the ground for a full stop. You could track stand for an hour at a stop sign, start pedalling and be ticketed.

I do not blow through stop signs at full speed, unless I can see there is no car in sight in all four directions, which is so rare I cannot think of the last time it happened. Even then, I usually at least slow down just in case I missed something. If there are cars around, I usually stop or roll slowly through. I suppose this is a risk but I think a pretty small one.

I understand the police do not write the laws, and it is not fair to make them interpret them. However, I wish they would use common sense in this case.

OMG they took him to JAIL???? what state???

I have my roadID and cell phone and that is it these days....if they don't like that guess I will be in jail for a long time!
