Elite ![]() ![]() ![]() ![]() ![]() ![]() ![]() | ![]() In Lee County Florida a local cyclist out on a group ride was struck by a motorist. The cyclist was rolled onto the hood of the car and across the windshield. thankfully the cyclist didn't suffer any severe injury. The kicker is that the motorist left the scene. She was found by law enforcement and admitted she knew she hit the rider but didn't stop because she was running late for a meeting. She wasn't arrested for leaving the scene, she was given a ticket and a notice to appear.

I can tell you that Leaving the Scene of an accident involving personal injury is a crime in Florida. Leaving the scene of an accident involving only property damage is a midemeanor. However, leaving the scene of an accident involving personal injury is a third degree felony maximum penalty is 5 years in prison (F.S. sec. 316.027). The requirement to stop and remain at the scene applies where the driver knew or should have reasonably known they were involved in an accident. |

She might have thought the cyclist was just riding across her hood and windshield. They do that, you know. |

Aside: If the "insurance after being hit by car" thread appears after this thread, we would have another pair of "Funny CoJ subjects beside each other" |

If it were just a pedestrian she probably would've been held. |

Master ![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() | ![]() Brock Samson - She wasn't arrested for leaving the scene, she was given a ticket and a notice to appear. The local bike clubs should be given notice to appear at that court date as well. Perhaps with protest signs, or maybe just with silent cold glares. Edited by faded_memories 2012-08-20 9:46 PM |
