Regular ![]() ![]() ![]() | ![]() McDonald's Corp MCD.N has been sued by a woman who said her two-year-old son ate a used condom he found in the play area of one of its restaurants in Chicago. Anishi Spencer filed the complaint against the fast-food restaurant chain on Wednesday in Cook County Circuit Court on behalf of herself and her sons, Jonathan Hines and Jacquel Hines. According to the complaint, Spencer and her sons were at a McDonald's restaurant in Chicago's South Side on Feb. 4, 2012 when Jacquel picked up the used condom from the floor, and shortly thereafter coughed up a piece of it. Both boys required medical care, and have suffered lasting injuries, pain and discomfort, the complaint said. Spencer accused McDonald's of negligence for failing to clean hazardous debris from the play area, and failing to use appropriate security measures to help uncover "deviant activities." The lawsuit seeks at least $50,000 of damages. "This is a very disgusting case," Jeffrey Deutschman, a lawyer for Spencer and her sons at Deutschman & Associates in Chicago, said in a phone interview. He said he tried to settle, but was unable to do so after having to deal with "layers and layers" of bureaucracy at McDonald's, which is based in Oak Brook, Illinois. McDonald's spokeswomen did not immediately respond to requests for comment. Jonathan is now 4 and Jacquel is now 3. Stuff happens ? |

I'd like to know what the lasting injuries are... Also the pain and discomfort, I doubt a 2 year old understands much about condoms. Stupid lawsuit all the way around. I hate how people just wait for something to happen so they can cash in. I say charge the mom with negligence and child endangerment for not watching her kid close enough to keep them from eating a condom, see how bad she wants to pursue the lawsuit then. |

I agree with this. Plus I have 2 kiddos and neither one of them at any age would have eaten a condom. Even at 2 they would have known better. Stupid people and their kids. Grrr |

I would say that it's up to McDonalds to keep its restaurants clean and condom-free. In fact, if I'm not mistaken, there are laws that require restaurants to be clean and, probably, condom-free. I agree that she shouldn't be letting her 2- and 3-year old eat McDonalds food, though, it sets a bad precedent and the kids will grow up eating there, get fat, and put undue burden on the healthcare system. And eating condoms is just stupid, unless you're a Conehead. Then it tastes like Bubblicious! |

I've had a couple of occasions to be in those"play areas".....I don't know who thought it was a good idea to have toddlers eating chicken, meat, greasy fries, etc. and then go crawling around on play equipment that rarely gets cleaned, much less disinfected, from the other little grubby crushers crawling around on it with food all over themselves.....but that's disgusting. |

Blaming the "idiot parents" and the "idiot kids" is pretty misguided...Sure I should worry about many things at McDonalds- but my child even finding a sperm-filled condom should not be one of those things. This is disgusting. |

I don't know whether or not the suit has merit, but I do know that it is possible for a parent to be watching a 2-year old and have something happen to the child at the same time. I don't know what happened here, and neither do any of the other commenters to this thread. Probably the issue is something like, and I don't know legal terms, who exercised reasonable care? If there was a condom on the floor in the childrens' play area, it seems fairly certain that McDonalds did not. What we don't know, is if the mother exercised reasonable care. |

Didn't read the link, but the norm is to merely plead an amount of damages in excess of the jurisdictional limit of the court (as opposed to what used to be called "limited" civil, out here the cutoff is $25K). It's not a limit, it's a floor, just gets you in the door. |

What we don't know, is if the mother exercised reasonable care. i'm glad someone with kids weighed in on this, cause i figured my reaction of "i didn't realize a parent could never take their eyes off of their child EVER" was going to get met with a "obviously you don't have kids." i think this story is certainly very icky and gross and not lawsuit-worthy, but this is america so we sue at will and judge strangers for things we have probably done ourselves (i have seen PLENTY of parents not paying attention fervently for the entire time their children are playing at a park/playground/mcds/friend's house/etc etc etc) |
